Study On The Legal Mechanism Of Joint Prevention And Control Of Air Pollution

With the acceleration of industrialization and urbanization,the problem of air pollution in China has become increasingly severe.Due to the holistic nature of the atmosphere,the scope of air pollution has gradually expanded from a local area to a regional area in recent years,leading to more prominent air pollution problems in China.The implementation of the regional air pollution joint prevention and control mechanism has become an inevitable choice to cope with the current air pollution situation.Up to now,a series of beneficial practices have been carried out in key areas of China.The newly revised "Environmental Protection Law" and "Air Pollution Prevention and Control Law" have also established a mechanism for joint prevention and control of regional air pollution.However,China's regional air pollution joint prevention and control legal system still has problems such as imperfect government cooperation mechanism,lack of organizational structure,imperfect accountability mechanism,and imperfect information sharing mechanism.Therefore,on the basis of summarizing the practical experience of China in recent years,we found the defects of the legal mechanism of regional air pollution linkage prevention and control,and constantly improved the legal mechanism of joint prevention and control of air pollution in China to ensure the normalization and standardization of the joint prevention and control mechanism.This paper includes three parts: introduction,text and conclusion.The text is divided into four chapters,which discusses the improvement of China's air pollution joint prevention and control legal system.The first chapter is an overview of China's air pollution prevention and control joint control in China,and introduces the current situation of air pollution in Beijing,Tianjin,Hebei,Yangtze River Delta,Pearl River Delta and other areas with serious air pollution,and then discusses the practice and dilemma of joint prevention and control of various areas of air pollution in China.The second chapter sorts out the status quo of China's air pollution joint prevention and control legal policy,and puts forward the following problems: lack of normal institutions and sound coordination mechanism,lack of accountability mechanism,lack of interest compensation mechanism,and environmental monitoring standards are not uniform.Information sharing mechanism and civic participation mechanism are not perfect.The third chapter discusses the experience of joint prevention and control of air pollution in the extra-regional regions such as the United States,the European Union and Germany,and concludes the enlightenment to the improvement of the joint control mechanism of air pollution prevention and control in China.The fourth chapter discusses the suggestions for perfecting the legal mechanism of joint prevention and control of air pollution in China,including the following five points,setting up a special normal organization for joint prevention and control,clearing the regional coordination mechanism,clarifying the accountability mechanism,and improving the air pollution prevention and control joint control area.Benefit compensation mechanism,unified regional environmental standards and air quality monitoring,regional information sharing,and improvement of citizen deposit mechanisms,to promote the effective implementation of joint prevention and control of air pollution in China.
