| With the deepening of the process of industrialization and the widening of regional development gap, which embodied in the field of atmospheric environment is, the air pollution become more serious and get a much more obvious trend of regionalization. The traditional unilateral governance model is not able to cope with this challenge, to explore regional cooperation, adopts the mode of joint prevention and control has been becoming one of the key of current work.The article covered four parts. The first part introduces the involved basic concepts and makes a summary, then analyze the necessity of carrying out this kind of working mechanism, and reviewed the development of joint prevention and control in the field of air pollution prevention and control in our country.The key point of the second part is to introduce the experience of other countries on dealing with the regional air pollution, especially the United States and the European Union.They both have taken various measures and means in this field, then analyze and summarize the enlightenment which these experiences can bring us.Then the third part analyzes the current existing problems among our work based on the present situation of regional air pollution prevention and control work, including the deficiency of legislation system, the defects of management mechanism and the non-strict accountability.Based on these defects and deficiency we mentioned above, the last part we focus on how to perfect the legal mechanism of regional air pollution joint prevention and control. I bring up my opinions mainly from the aspects of legislation, law enforcement and accountability, including consummate the legislation system, clear and update guiding ideology, establish a top-down management system, definite the responsibility of each part, carry out joint law enforcement and strength the judicial guarantee.Above all, air pollution is one of the key challenges for us, therefore the prevention and control constitutes the emphasis of our current economic and social work, in the face of the trend of regionalization of air pollution, joint prevention and control is relatively reasonable and effective. For the work of regional air pollution prevention in China starts late, the related legal system is not mature and perfect, which results in conflicts of interests stay in unsolved. Therefore we should combine our experience obtained from the current work with the excellent foreign experience for reference, then take a study on how to improve and perfect the legal mechanism of joint prevention and control from the different sides of legislation and so on, that is very necessary and meaningful. |
