Research On Legal Mechanism Of The Joint Prevention And Control Of Pollution In The Trans-Boundary Basin

In recent years,the frequent occurrence of pollution incidents in China's trans-boundary basin has highlighted the dilemma of pollution control in China's trans-boundary basins,aggravated the conflict of interests among the river basins coastal districts and seriously affected the overall process of China's ecological civilization construction.The purpose of this paper is to study the current situation,predicament and perfect countermeasures of the legal mechanism of pollution joint prevention and control in China's trans-boundary basin through using the research methods of literature analysis,case analysis,empirical analysis and comparative analysis.This paper is divided into five chapters: the first chapter is the introduction,which discusses the background and significance of the research,the present situation of the research at home and abroad,the research methods and the innovation.The second chapter introduces the related concepts and theoretical basis of cross-administrative pollution prevention and control.The third chapter studies the present situation of China's trans-boundary basin pollution joint prevention,Based on the investigation of the current situation of joint prevention and control of pollution in key river basins and four typical cases of trans-boundary basin pollution prevention and control,this paper analyzes the existing difficulties of the legal guarantee mechanism of the joint prevention and control of pollution in trans-boundary basin in China: that is,the legislation of the joint prevention and control of pollution in trans-boundary basin is not completed,the administrative cooperation mechanism is not perfect,and the public participation is not sufficient.The fourth chapter discusses the concrete system and the enlightenment to our country of the joint prevention and control of pollution in the trans-boundary basin.The fifth chapter summarizes the perfect countermeasures of the legal guarantee mechanism of the joint prevention and control of pollution in the trans-boundary basin of our country,that is,to perfect the legislation system of the joint prevention and control of pollution in the trans-boundary basin,to perfect the administrative cooperation mechanism,to promote the cooperative governance,and to ensure the public participation in thelegislation,Promote the coordinated treatment,so as to promote the modernization of the system and capacity of the coordinated treatment of water pollution in the river basin.
