Study On Red Line System Of Watershed Ecology

In economic development,people only pay attention to the economic benefits of river basins,but neglect the ecological benefits of river basins in order to unilaterally pursue high-speed economic growth.Overexploitation and utilization of ecological resources in river basins can easily lead to degradation of ecological functions in river basins,so it is urgent to protect the ecosystem of river basins.Based on the connotation of the ecological red line system in the river basin,this paper puts forward some suggestions on the improvement of the ecological red line system in the river basin by analyzing the problems existing in the actual work of delimitation,protection measures and violation of the legal responsibility of the ecological red line in the river basin.Based on the delimitation of ecological red line in river basin,the main body,standard and problems in the process of delimitation of ecological red line in river basin are analyzed.Because of the particularity of river basin system.We will increase the number of river basin management agencies as the main body for delimiting the ecological red line of the river basin.We should improve the criteria for the delimitation of the ecological red line in the river basin and take into account the coordination of interests among different regions in the process of delimiting the ecological red line in the river basin.The procedure for delineating the ecological red line of the river basin is further clarified.As for the protection measures of the ecological red line in the river basin,there exists red line supervision in the implementation of the ecological red line system in the river basin,which divides the integrity of the ecosystem.Lack of unified monitoring standards.Lack of public participation and single incentive measures for ecological red line compensation.Through the integration of the river basin cross-regional supervision and management forces,the unified supervision and management of the river basin environment and comprehensive law enforcement agencies are established.Establish a joint monitoringand monitoring cooperation mechanism,improve the public participation system.The system of ecological compensation should be improved by market-oriented mechanism.The legal liability of the ecological red line system in the river basin is discussed from three aspects: civil,administrative and criminal.In the aspect of civil liability,it is suggested to increase the amount of civil compensation and supplement the punitive liability.In the aspect of administrative liability,it is suggested to establish the liability without fault as an exception,to refine the standard of administrative discretion and to increase the amount of administrative fines.In the aspect of criminal responsibility,it is suggested that life imprisonment should be added to criminal responsibility,the upper limit of fixed-term imprisonment should be raised,and non-penalty measures should be supplemented.
