Research On The Legal Protection Of The Ecological Red Line

In the rapid development of industrialization and urbanization, our ecological environment suffered from serious pollution. Some corresponding environmental protection measures were taken, but the effect was not significant, which closely related to we focus on the traditional protection of the single environmental elements. To maintain the ecological security, we need to protect the ecological environment as a whole. Therefore, we creatively put forward the ecological red line. Then it was written in the new revised "environmental law". Implementing the legal protection of the ecological red line is not only undoubtedly a rational option to deal with the deteriorating ecological environment, but also a necessary way to transfrom the current management system of environmental protection. What is more, it is a basic way to make our national ecological security situation better. Although both central and local governments carried out the protection in different degrees, the newly revised "environmental protection law" is too high probability and is not easy to operate and lack of a special management legislation of the ecological red line in the national level, it suffered from some difficulties. On one hand, the protection of the ecological red face difficulties. On the other hand, the implementation of the ecological red line also has difficulties. What is the worse, legal liability is undefined.This paper attempts to begin from the meaning and theoretical basis of the ecological red line to clarify the necessity about legal protection of ecological red line at present. Then try to evaluate the protective status of the ecological red line in the both central and local governments and to analyze the problems. Finally putting out some corresponding measures to the problems, in order to benefit the legal protection of ecological red line.Full text of three parts:The first part is to introduce the general theory of the legal protection of the ecological red line. Just because the concept of the ecological red line was put forward in recent years and was still a creative concept in our country, which has no mature experience and theory for us to refer to. In order to strengthen the understanding of the concept of ecological red line and clear the way for the protection of the ecological red line, the paper then to sum up the concept, feature, theoretical basis and necessity of the legal protection of the ecological red lines.The second part is the first to analysis of the status of preservation in the both central and local governments. Then list the following problems of the legal protection of the ecological red line. There are shortcomings in a special management legislation, implementation, the protection and the legal responsibility.The third part is based on the involved theory of environmental protection law and the relevant local protective experience, then put forward some suggestions on the legal protection of the ecological red line, aiming at solving the present problems.
