In recent years, with the urbanization and the population surge, some natural ecosystems fragile areas was severely damaged, the main function of the ecological system gradually degraded, may endanger the region and even the country's ecological security. In this case, the State presented a creative model for environmental protection- ecological red line. Ecological red line is the national designated minimum ecological protection space which in important ecological function areas, ecological sensitive areas, fragile areas and other areas. As a bottom line of thinking, it's make a direction to protect out natural ecosystems. Although the ecological red line has been written in the environmental law, but it has not formed a complete legal system yet, therefore, it's urgent to establish the ecological red line legal safeguards system.This article is based on the current situation delineation and protection of ecological red line, to clarify the definition of ecological red line.It's also based on the system theory, the theory of ecological carrying capacity, environmental risk management theory. And it lists three types dividing of ecological red line.By the research of ecological red line development where some local provinces, such as Jiangsu province Research, Tianjin, Beijing, Tianjin and Hubei. It found that China's ecological red line there is a lack of relevant legislation at the national level ecological red line, the specific legal system is not complete and other issues.And it introduced that the United States, India, Japan, EU and other countries and organizations have make the successful experience in ecological red line.Our establishment of ecological legal system need to follow the basic principles of ecological holism, conservation priority, partitioning hierarchical classification, ecological risk prevention. To build the special eco-specific legislation red line, improve ecological red line with relevant laws and regulations, formulate local laws and regulations ecological red line,and establish the specific ecological red line legal system, such as: monitoring and evaluation system; environmental access negative list system; differentiation of control; unified regulatory system; environmental risk monitoring and early warning and prevention mechanisms; regional ecological compensation system; performance evaluation system; ecological red line legal liability system.
