Research On The Collaborative Supervision Of Emission Control Area Of Shanghai Port

Since the 18 th CPC National Congress,the central government has carried out a series of major policy decisions,among which the promoting of a conservation culture is the hottest topic and highly valued by the central government and the society.The Fifth Plenary of the 18 th Central Committee of the CPC proposed the concept of Green Development for the first time.However,air pollution caused by the vessel operation in big port cities cannot meet the expectation of the public,thus leading to social tensions.The public continuously submits proposals,motions and opinions in this respect to the government,and thus derives a public policy issue,especially in Shanghai.The 13 th Five-Year Plan for Development of Shanghai International Shipping Center released by Shanghai's municipal government in September 2016 proposed that during the period of 13 th Five-Year,the annual container throughput of Shanghai Port will reach 4.2 million TEU,a collection and distribution system which is modernized,scaled,intensive,quick,efficient and structured will be established to match the international shipping center status of Shanghai,and Shanghai will be developed into the largest cruise home port in Asian-Pacific region etc.With the prosperity of shipping industry,air pollution caused by ship emission has attracted more and more attention of the public and government.In April 2016,Port of Shanghai took the lead in implementation of the supervision of emission control area in the whole country for the control of the pollutants emitted from ships.The public administration of this new supervision is the research object of this article.This article sets forth the background and importance of emission control area supervision in Shanghai and summarizes relative domestic and foreign literatures,complying with two legal systems,international conversion and national law,through the perspectives of new public service theory and collaborative governance as well,taking the method of document research,comparison research and case analysis and based on the writer's personal experience of navigation and maritime administrating for more than 10 years.This article also introduces the concepts,legal principles and theoretical basis of emission control area supervision,puts forward and analyzes supervisory problems,and proposes a better approach of collaborative governance for the supervision of emission control area on the basis of considering the advanced concepts and experience of Europe,US and Hong Kong,China,and the actual practice of Shanghai.
