Research On Legal Guarantee Mechanism Of Rural Land Renovation In China Under The Legalization Of Ecological Environment

With the deepening of reform and opening up and the accelerating pace of urbanization,the development and utilization of land resources during the process of rural land use has been increasing,and the problems have also been highlighted.Under the background of continuous innovation in the legalization of the ecological environment,how to achieve the coordinated development of the development and utilization of rural land resources and rural areas has become the primary issue concerning the survival and development of human society.Rural land remediation shows its great potential as an important way to adjust man-land relations,increase the intensive use of land resources,maintain rural ecological balance,and realize the legalization of the ecological environment.This paper focuses on the current situation of rural land consolidation in China,sorts out laws and regulations related to rural land remediation,and puts forward proposals for improving the legal safeguard mechanism for rural land remediation in China under the legalization of the ecological environment.At the legislative level,China has initially established a system of laws and regulations related to rural land rectification,but it has not yet established specific measures for environmental protection in the process of complete rural land remediation.At the law enforcement level,rural land remediation has been over-dominated by governments in particularlyremote areas and is based on economic benefits.The chaotic situation caused by the“One Word Church” also needs to be regulated.Under realistic problems,this paper explores the underlying causes of the predicament of rural land consolidation.Comparatively drawing on the advanced models and legal systems of major foreign countries,we have proposed the improvement of rural land in China,and in particular suggestions for improving the lack of environmental protection in rural land remediation.In terms of legislation,it is proposed to improve the environmental protection legislation and related standards and systems in the process of rural land remediation,such as the rural land remediation procedures and the basic principles of rural land remediation.Rural land remediation environmental protection standards system,rural land consolidation land quality classification system;in the field of law enforcement,it is proposed to form a coordination mechanism for the risk management and supervision of rural land rectification,supervision of government actions and inaction as well as government departments.The purpose is to promote the improvement of the level of rural land remediation in China,and to realize the legalization of the ecological environment.
