Study On The Legal System Of The Ecological Land Protection

With the fast development of the economic and the urban expansion in ourcountry, the demand of land is becoming more and more. A lot of ecological landwere encroached and destroyed, such as wetland, grassland, water and so on. Theecological function of land degenerated heavily, the fragile ecosystem become moredangerous. On this background, it is necessary and urgent for supporting ecologicalsafety to take legal measures to protect the ecological land and play its ecologicalfunction. So the paper claims that constructing the legal system of ecological landprotection, the main content is as follow:Discussing the definition of the ecological land: owing the prominent ecologicalfunction or the important ecological position, and having important sense for theecological safety of the region, the ecological function should be protected. For thecountry’s ecological safety protection, the country should preserve a certain amountecological land. Then, explaining the reasons for the ecological land should be asindependent land type, and defining the range of the ecological land.The legal system of ecological land protection was constructing by thegovernment under the background of the ecological land becoming more and moredangerous, its main content and core goal is protecting the ecological land and theecological safety. Though investigating the protect situation of ecological land, we canknow that the legal construction of ecological land protection is lagging, so we needto construct the legal system of ecological land protection. Then, discussing theconditions of constructing the system from three aspects: law, policy and technology.On the base, discussing the basic principle the system should follow.The basic content of The legal system of ecological land protection shouldinclude:(1) taking different measures to the ecological land: prohibiting expropriatethe basic ecological land and restricting expropriate the other ecological land;(2)regulating the process of expropriating the basic ecological strictly;(3) establishing comprehensive management system to strengthening the management of theecological land;(4) constructing the liability system of the ecological land.In addition, protecting the ecological well should insist the legal system ofecological land protection and the correlative system are coordinated. According theactual needs of the legal system of ecological land protection, discussing the concretescheme to perfect the system of land type; advising establishing the ecological landplanning system; the Legal System of Ecological Land Protection should coordinatewith the Natural Reserve System.
