Study On Legal Problems Of Soil Heavy Metal Pollution Prevention And Control

Soil is the foundation of the growth of all things.It is the basis of human survival and development,which is directly related to food safety and ecological safety.But with the continuous economic development,soil pollution has become increasingly serious,especially the heavy metal pollution of soil.In recent years,according to statistics,by the end of 2012,China has about 20 million hectares of arable land polluted by heavy metals,accounting for 1/6 of the total area of arable land,soil heavy metal pollution is facing the grim situation.Therefore,it is urgent to build a legal system for the prevention and control of soil heavy metal pollution in China.At present,soil pollution prevention and control law of our country is still in the drafting process,for the problems in the practice of using the rules only from the "environmental protection law","Basic Farmland Protection Ordinance" and other relevant laws and regulations,and are scattered,some provisions in principle,unable to meet the needs of the prevention and control of pollution of heavy metals in soil in china.The main topic of this paper is the legal research on heavy metal pollution prevention and control in soil,mainly from four parts.The first part is an overview of heavy metal pollution in soil.The concept,characteristics and hazards of heavy metal pollution in soil,as well as the current situation of soil heavy metal pollution in China are discussed in this paper.The second part is the analysis of the legal problems of the prevention and control of heavy metal pollution in the soil.This part mainly expounds the current situation and existing problems of the legal provisions of soil heavy metal pollution in China.The third part is about the laws and regulations concerning heavy metal pollution prevention and control in the soil in foreign countries.This article only chooses the two typical countries of the United States and Japan,and makes a detailed interpretation of the two countries' laws concerning the prevention and control of soil heavy metal pollution.The contents of the United States Superfund law and the soil pollution countermeasures law of Japan are detailed and detailed,and many of these two legal systems are in detail.All of them have a reference to the construction of the legal system for the prevention and control of heavy metal pollution in China,and build a legal system for the prevention and control of soil heavy metals pollution in China.The fourth part is the core content of this article,that is,China's heavy metal pollution prevention and control legal proposals.This part has been described from seven aspects.For the problems that can not be solved in the special legislation of soil pollution prevention and control,it can be defined by legislative interpretation and judicial interpretation.In view of the current situation of heavy heavy metal pollution in soil,the special fund system of soil prevention and control is formulated to prevent and control soil heavy metal pollution.For the support of funds,to determine the principle of soil pollution imputation,to improve the system of information disclosure of soil pollution,to divide the area of soil heavy metal pollution and to improve the environmental monitoring standards,and to standardize the law enforcement of soil heavy metal pollution.
