In recent years, with the development of tourism, especially in the development process ofhistorical and cultural heritage as tourism resources, humane and ecological destruction has been agrim situation and continued edeteriorating. These include: pollution of the buildings, destructiveconstruction, destruction of cultural relics, over-expansion of antique buildings, destruction of localculture and customs with traditional characteristics, unregulated selling of antiques at tourist sites,ubiquitous uncivilized behavior of the tourists. These shortcomings not only destroy the naturallandscape of the tourist areas, but also reduce the value of cultural tourism resources, and evencausing irreparable damage, and at the same time exerting a negative impact on the local traditionalculture. The Environmental Protection Law if of the relevant provisions on the development oftourism resources and ecological environment protection, scenic areas in China, focusing on theprotection of cultural heritage resources development, planning, construction and management playa role. However, those related to humanities and ecological environmental protection are sporadicand scattered, and the lack of the provisions to rectify has damaged the ecological environment. It isa systematic engineering to protect the humane and ecological environment and curb the destructionof tourism resources in the development. At the heart is the effective legal means based onmandatory, normative, guide, educational and other characteristics. Compared with foreignprotection of the humane and ecological environment with high levels of developed countries,China's legal system for humane and ecological environment management and legal protectiontourism is not perfect in terms of legislation, law enforcement and justice. It is necessary for Chinato pay attention to the legal protection of the humane and ecological environment in thedevelopment of tourism resources by establishing a sound legal system, law enforcement systemand supervision system, gradually making for legalization and standardization.The thesis discusses how to strengthen legal protection of the humane and ecologicalenvironment in developing these resources. It is mainly divided into four parts:The first part is to overview on the humane and ecological environmental issues caused by thedevelopment of tourism resources. It starts with the definition of tourist resources and the ecologicalenvironment, the characteristics of the discourse; then describes the relationship between tourismdevelopment and humane and ecological environmental protection, and points out that tourismdevelopment and human and ecological environmental protection is not absolute contradictiory.Benign tourism development and cycle through the use of the rational development of tourismresources and cultural ecological environment, could provide material bases and conditions for the protection and improvement off the humane and ecological environment, and play a catalytic role.Finally, the paper summarizes, analyzes problems and causes of tourism caused by the developmentof the human and ecological environment.The second part discusses the problems of humane and ecological resources, legal protectionand tourism legislation. After the founding of New China, China has formulated laws andregulations involving the protection of cultural heritage, scenic protection and cultural arts laws andregulations. These laws and regulations are designed to protect China's nature reserves, scenic spots,focusing on cultural heritage resources such as development, planning and constructionmanagement, leading to the direction of the legal protection, which have played a protective role inpromoting stability and development. But these are not without problems, they mainly include: lawsand regulations relating to the protection of the humane and ecological resources in China are veryunsound, unscientific of the management system; the absence of some areas in the tourismlegislation, the legislative level is too low, lack of uniformity in legislation, poor operability.The third part introduces foreign scenic spots and cultural heritage protection and tourismdevelopment management system, legal system and the enlightenment. In the United States, Japan,France and other major developed countries, their historical and cultural heritage protectionmechanisms are comparatively distinctive and relatively comprehensive. Both the degree ofemphasis on historical and cultural heritage protection, and cultural heritage protection concepts,are all worthy of our country to learn. These advantages include: strengthening the legal protectionof historical and cultural heritage management, the establishment of the historical and culturalheritage of scientific management system, emphasis on civil society organizations in tourismdevelopment, the role of the humane and ecological environment protection, the implementation ofthe overall protection of cultural heritage.The fourth part makes suggestions to improve the legal protection of the humane andecological environment in the development of tourism resources in China. The first is to improvethe humane and ecological environmental protection legislation with sustainable development as aleading concept for cultural heritage conservation and tourism development legislation; establishprinciples for protective use of tourist resources, applicability and operability of laws andregulations, and public participation; to foster systems of environment impact assessment, licensingand public participation in cultural heritage development. The second is to strengthen the lawenforcement system, setting science of law enforcement management agencies, establish soundadministrative law enforcement responsibility, to improve the quality of law enforcement teams.Finally, it is necessary to establish a sound human ecological and environmental protectionmonitoring mechanism, to strengthen administrative governance, judicial oversight and public monitor.
