Research On The Coordination Of Public And Private Interest Conflicts In China's PPP Model

In recent years infrastructure bottlenecks encountered crisis in China,the development pattern of government-led investment face great challenge.Starts from 2013 the PPP model officially entered the public eye,with the flourishing of the PPP model,and the legislation related to the PPP is relatively backward,as the main mode of the government and the private sector increasingly significant,the conflicts of interest affect the advantages of the system itself volatile,even endanger the PPP model smoothly develop,which makes the coordination problem of the PPP mode in public and private interests conflict research is imminent.At present,China's current laws,regulations and policies related to the PPP to department regulations or local decrees,authority is not enough,even contradictory part file,makes the social capital of the PPP project participation is low,the social from all parts of life to make the act of government and social capital is high.PPP mode is a tool which can activate economic develop,and the reasonable distribution of the public and private interests is the key of the whole model develop smoothly.The conflict of interests coordination problems affect their legitimate rights and social capital investment enthusiasm,and is helpful to enhance the function of the government efficiency,even puts forward new requirements to the our country present legal system.Based on the practice and the analysis of the various appearances,from the perspective of both public and private interests,focus on reasons of public and private interests conflict on the legislation level,then discusses how to solve public and private interests conflict coordination in our country.The author thinks under the background of current economic,PPP will continue to catch more and more attention.the public and private interests conflict issues are increasingly urgent,although the standpoint of both public and private is different,but they till can reach the win-win effect of the game.The author thinks that the two conflicts occur frequently,also is not easy,but in view of the PPP project has characteristics of a long cycle,large investment,risk of uncertainty,the conflict is inevitable.By rights,responsibility and benefits clear to both parties;specification of risk and benefit sharing mechanism;the role of government transformation,both sides of the conflict can be controlled in a reasonable range.The author thinks under the background of country advocates the PPP mode,the PPP project and participants who intention to the PPP project investment will be more and more,and domestic at present,the successful PPP case is lack,some seemingly successful case has much contradictions conflict in later,so I think now the most urgent is to harmonize the two big conflict of interests subject,guide the PPP model with a successful example.
