Research On The Rights Of Membership In A Rural Collective Economic Organization

Though many contemporary scholars had elaborated on the rights of membership in a rural collective economic organization,but these researches are mostly about the identification of the membership in an organization,on the other hand,researches on the legal differences of the rights between that of the members are rare.While these differences constitute the basis to sooth the conflicts between the members,it is absolutely necessary to elaborate on these issues.Through historical analysis,positive analysis and literature analysis,this article discussed about the cause and performance of the differences between the rights of the original members in a rural collective economic organization and that of the new members,to promote in-depth researches on the rights of the membership,in hope to solve the realistic problems.This article could be divided into five parts:the first part analyzed the concept and nature of rights of the membershipin a rural collective economic organization,that these are special rights of the membership.The second part analyzed the contemporary status of the identification of the membership,and promoted a new system and standard for identification,which is easy to operate.The third part analyzed the content of membership rights of rural collective economic organization,including the property rights and the non-property rights.The fourth part discussed about the jurisprudence basis,historical basis and legal basis of the differences between the rights of different members,and concluded that these differences are legitimated.Taking this conclusion as a basis,this part also discussed about several typical differences of rights between that of the members.The fifth part put forward several proposals for the legislation ina rural collective economic organization and the legal remedies.
