| Since 1980 s,the household contract responsibility system has been gradually unable to adapt to the pace of the development of modern rural collective economy,and it also causes the internal management of rural collective economic organizations to be stuck.On this crossroad,the introduction of the policy of "separation of three rights relating to agricultural land" is so significant.It not only represents the fundamental interests of farmers,but also plays a positive role in promoting the whole rural economic system.The "separation of three rights relating to agricultural land" policy laid the key to the development of our country's agricultural economy in the future.The goal of "strengthening the ownership,realizing the separation of the right of contract and management" can be attributed to the content of the membership system of the collective economic organization.In addition to the change of the existing collective economic organization,the improvement of the system of membership is more important in the future legislation.At present,there are few legal provisions concerning the membership rights of collective economic organizations in China,which can't deal with the dispute of members of all kinds of collective economic organizations.The author believes that the construction of collective economic organization members right to focus first on members of the qualification standards,members of the right to social security function as a benchmark,rather than simply to the household registration of identity;members of the right content to the "separation of three rights relating to agricultural land" of contract and management rights as a priority,while giving members effectively the exercise of the right to participate in the organization management,arouse the vitality of collective economic organizations;the members of the right relief function of relief should rely on the judicial trial. |
