Analysis Of The Protection Of Copyright In The Digital Transformation Of Traditional Book Publishing In China

The healthy development of the publishing industry is inseparable from the protection of copyright protection rules,but for now,the status of copyright protection of traditional books under the digital background is not optimistic.Of the ten national cases against infringement and piracy released by the National Copyright Administration in 2016,two are related to digital book infringement,and five are related to Internet infringement.Such infringement has adverse effects on the digital transformation of the traditional book publishing industry,so it is necessary to study the current situation of infringement and find out the relevant solutions.This paper argues that the traditional publishing enterprises in the process of transformation mainly adopt six kinds of transformation strategy,namely direct digitization of paper books(including construction of the digital library);traditional books into multimedia books;development modeled on the database mode;copyright trading;channels and content cooperation;network literature and traditional publishing combination.In the concrete transformation process,because digital books are not transmitted by paper carrier and digital book publishing industry chain eliminates the logistics links and other reasons,produce many problems of copyright: readers use technical means to obtain digital books in intentionally or inadvertently,violate the relevant interests of the copyright owner;because the lack of resources and the high cost,digital book publishing organizations often carried out the development and publication of digital books without the authorization of the copyright holder;The traditional pre licensing and post publishing model is challenged,and how to obtain massive authorization becomes a problem;the digital publishing industry chain has added the intermediate link,and network business often uses his position for infringement;In the digital environment,there are some new types of books,but there is a lack of legal protection.This paper argues that the present legal norms have made specific provisions for the protection of digital books,but there are still some deficiencies: the duplication right excessively controls readers' access to digital books,it can not fully play the role of digital books,but also difficult to meet the needs of readers;internet service provides a "safe harbor" system,the network service in order to escape their responsibility for the examination;according to the provisions of the first licensing and post use,only cracking down on illegal acts of digital publishing enterprises can not prevent the infringement of enterprises;the lack of specific provisions on the books and multimedia database.These deficiencies may make the public in violation of the law in digital reading from time to time.At present,the relevant international copyright protection norms are in line with our country,emphasizing the protection of copyright owners' interests,strict control over related violations and insufficient consideration of social interests.Finally,this paper argues that the problem of the traditional book publishing in the digital transformation should be taken legal,technological and ethical measures to solve,and based on the above analysis and discussion,the author puts forward some suggestions to solve the problems: narrow the control scope of copy rights and establish compensation mechanism;expand the scope of network content providers and strengthen their responsibilities;legal licensing to solve massive licensing issues;take technical measures and unified digital book production standards;to protect database and multimedia works by copyright law;strengthen the moral constraints and the establish digital public library.
