| In recent years,great progress has been made in rural construction in China,and the rural economy has developed rapidly.In the farmers' living standards continue to improve at the same time,we found out he was deteriorating living environment,worse from day to day,especially the rural environmental pollution is increasingly serious.At this stage,due to some of our misconceptions and knowledge,the rural areas are gradually neglected in the development process.The worsening of the rural environment,at the same time,it will lead to social disharmony,the gap between urban and rural areas is more bigger,diseases caused by environmental pollution and related rights violations are more likely to produce new social contradictions and disputes,to solve the current existence of these problems and contradictions to the healthy development of social economy have a positive effect.Therefore,it is necessary to strengthen the research on the current issue of how to manage the problem of rural environmental pollution.This article begins with the current situation of the rural environmental pollution of our country and hazards are analyzed in detail,analyzed the cause in law,and finally,in the legal point of view of legal countermeasures of pollution control in rural areas in China.In the center of the "city" and under the system of dual structure between urban and rural areas,rural environment problem is becoming more and more serious,although our government has adopted many measures,but still no improvement.At this stage,China's rural environment pollution is mainly manifested in: agricultural production pollution,rural industrial pollution and agricultural life pollution.Agricultural production pollution:excessive use of fertilizers,straw burning at random and unreasonable use of agricultural film,has greatly on the agriculture production environment pollution;Aspects of industrial pollution: the "three wastes" of township enterprises,livestock and poultry farming and pollution transfer between urban and rural areas;Rural life pollution: life and waterpollution problems,etc.The pollution has caused great damage and pollution to the rural soil,the atmosphere and water resources,seriously affecting the development of agriculture and people's health.Rural environmental pollution is very serious,investigate its reason,mainly caused by a lot of deficiencies in the legal norms in our country,the legal reasons mainly reflects in: China's rural environmental legislation is not perfect,rural environmental protection law enforcement is not standard,as well as rural related causes of subjects' legal consciousness.Aiming at the legal cause of rural environmental pollution in our country,puts forward the corresponding legal countermeasure,to be able to make up for the existing legal defects,and improving the rural ecological environment in China.This paper analyzes the problems and shortcomings of the legislation,law enforcement and citizens' consciousness.By learning and understanding of the experience of the foreign advanced countries,specifically from the United States,Germany,Japan and South Korea,the theoretical research and practical experience of these countries,learn their advanced system of ideas and measures,and on the basis of the existing in our country actual,put forward to perfect our country rural environmental legislation,establish the "unified" legislative idea,promote citizens' environmental right into constitution,strengthen key areas of legislation,the author put forward to enact a rural environmental protection ordinance,pollution mainly aimed at the rural life and production of pollution,the prevention measures are put forward;At the same time,we should strengthen law enforcement in rural areas and ensure the effective implementation of rural environmental laws and regulations.Finally,we should constantly strengthen the environmental legal consciousness of the relevant subject in rural areas,and finally realize the construction of a new socialist countryside. |
