| In recent years,along with the strategy of in-depth implementation of "the rise of central China",cities surrounded Wuhan,including Wuhan are accelerating its urbanization,social and economic are developing rapidly,while at the same time it leads to serious haze fog issue.As the pilot area of resource-conserving and environment-friendly society,focusing on solving this problem is a must.But relying on the current traditional pollution control methods cannot meet the mission of solving haze problem.Therefore,it is to necessary to perfect the legal system timely to benefit solving haze of Wuhan urban circle.Based on the actual haze situation of Wuhan urban circle,use the methods of statistical investigation,empirical research,comparative analysis and so on.according to the general logic of raising problems,analyzing problems and solving problems,this paper proposes the following research ideas:The first chapter tells about the basic haze situation of Wuhan urban circle.The current characteristics of Wuhan urban circle haze are:air quality testing can not reflect the occurrence of haze;it occurs with high frequency and long duration;the main pollutants concentrate and exceed the standard seriously;it differs from seasons to regions.Also the survey data indicates that,the main source of Wuhan urban circle haze is industrial emissions,vehicle exhaust emissions,and biomass burning and dust,etc.The second chapter speaks the evaluation of Wuhan urban circle haze governance system effect.Here mainly from four aspects of Wuhan urban circle haze governance system of legal system to evaluate the implementation effect,that is:testing system;total air pollutant emission control system;haze fog collaborative governance system and public participation,through which we get these:for the haze monitoring system,more rigorous local standards wasn’t established,absent the division of environment air quality function district;for total air pollutant amount control,air pollutant emission quota distribution system is not perfect,the pollutant emission right trading system existing market disorder;and for haze collaborative governance system,it is lack of clear provisions of laws and local regulations,basic conditions are immature;for haze governance system of public participation,the lack of basic conditions and the legal system lead to less public participation,etc.The third chapter mainly talks about a comparative analysis of the legal system of haze governance.Through the examples introduction of London,L.A and Beijing about haze governance situation to point out the similarities and differences on haze governance.Then analyzes Wuhan urban circle haze governance experience:one must have an excellent haze monitoring system and total air pollutant emission control system;also have cross regional governance haze cooperation and actively promote public participation in governance haze.The fourth chapter gives some legal suggestions about how to deal with Wuhan urban circle haze.Firstly,improving haze detection system from the setting of the local detection standard system and scientific layout of monitoring point;secondly,improving the trading system of atmospheric pollutants emission rights and adjusting air pollutant emission index distribution system to perfect the total amount of air pollutant emission control system;thirdly,haze governance system from the establishment of a unified city circle and the construction of cooperation governance mechanism between the urban circle to promote regional cooperative governance system;forlhly,from the construction of the basic conditions of public participation and improve the relevant legal system guarantee to implement the system of public participation in governance haze. |
