Investigations On Attributes And Protection Mode Of PCB Diagram's Intellectual Property

PCB, known as "the mother of electronic products" is the abbreviation of Printed Circuit Board, which Chinese called ‘Printed circuit boards' or ‘Printed wiring boards'. As the skeleton of electric circuit, PCB has been widely used in our daily life.Along with the advancing south of PCB industry and the advancement of Asian migration, China has become an important field of the PCB research,development, production and trade. At the same time, with the development of copy board related with PCB, infringement of PCB, has become a big problem in the PCB industry and law. The research of protection mode for Intellectual property rights theory and practice related with PCB's diagram of intellectual property rights meanwhile is growing.Based on the analysis of basic characteristics of PCB diagram, the author argues about it's intellectual property attributes. By comparison and analysis, it can be concluded that under the premise of its intellectual property attributes and combining the traditional with current IPR protection mode of comparative analysis, it can be designed the suitable protection mode for IPR of PCB diagram from the angle of its basis property, right protection and infringement.This paper consists of three basic parts of introduction, text and epilogue and the body part consists of the following four parts.The first part mainly introduces the basic knowledge of PCB diagram. In combination with its basic property and the properties of the object of intellectual property rights to contrast, it can be concluded that PCB diagram has its intellectual property attributes.In the second part, from the perspective of legal and economic benefits to demonstrate the legitimacy of PCB diagram of intellectual property rights protection respectively, on the basis of combining the current and traditional copyright, patent, against unfair competition, layout-design of integrated circuits for the protection of IPR protection object features, the author contrasts whether traditional IPR protection mode is suitable for PCB diagram of the IPR protection.The third part is on the basis of the analysis of the second part that the mode of traditional IPR is not suitable for PCB figure protection. On the basis of combining the present situation of foreign PCB diagram of intellectual property protection, the author refers to its model.The fourth part, on the basis of the above analysis and demonstration to observe the current advice about PCB diagram of IPR protection, the analysis is mainly focused on the design of special legislation for PCB diagram of Intellectual property protection.This paper, combining present situation of intellectual property protection of PCB diagram and its basic properties, based on judicial practice and good lessons from foreign protection mode,by means of comparative analysis and theoretical demonstration, can know intellectual property attributes of PCB diagram and actively seek suitable and benefit pattern for protection ofintellectual property rights. Finally, referring to layout-designs of protection mode for integrated circuits, this author investigates and designs IPR protection mode shape of the PCB diagram for our Country in order to provide a good theoretical basis and practical model for our country's IPR protection of PCB diagram.
