The forty-one of China's constitution stipulates that citizens should enjoy the right of supervision on the staff of state organs and state organs.This makes the citizen right of supervision has been recognized by the law.With the rapid development of the Internet,the citizen right of supervision is changing from one platform to another.The continuous improvement of Internet technology makes the network governance and network politics possible.More and more people began to pay attention to state affairs to express their opinions and views through the Internet platform. However, the current state of the citizen right on network supervision lacks of clear legal provisions.This leads to the citizens in the exercise of the network supervision lacks of relevant legal guarantee.The phenomenon of network on public opinions, the network violence and network trial becomes serious.At the same time, the network supervision in exercise also has been strong interfered by the power of national public, leading to the constitutional rights of citizens have been infringed.The domestic research about the network supervision, which has been relatively mature,but in the perfect point still can be added at present.This paper analyzes the realization between the significance and problems of the network supervision,expecting to find out the method which both to ensure that the reasonable exercise and can give full play to the citizen right of supervision of the public power of the state to limit.From the content, this paper can be divided into four parts: The first is to define the network supervision right. From the current scholars through research, the main object of network supervision is the servant of public and the state.The author through the analysis of the evolution process and supervision of network supervision,puts forward the new definition.Then the next is the analysis of legal origin,to provide a reliable legal basis on supervision of the exercise.By the new definition, the second part is to realize the value and the analysis of existing problem,and strive to find out the value and the reason on the existing problems.The third part is the reference of foreign legislative,to provide a reliable reference for the legal supervision of civil rights legislation of network.The last part is aimed at the existing problem,put forward improvement suggestions on the legislation,government,three party organizations and citizens.Looking forward to the network supervision can be effectively protected by law.
