The influence which the network of public opinion impacting on the society isbigger and bigger, in this context, more and more people intend make use of internets’influence to protect their interests. In addition to these successful cases, as the sametime, it also caused a series of legal and ethical issues, which should be took intoaccount by public. Hoping to this paper is benefit to resolve the problem mentionedbefore, we researched it here.The article introduced the case of Yaojiaxin at the beginning;For the first part, We investigated related concepts at the beginning, such as publicopinion, the network public opinion and so on;Then, we analyzed the reason why the phenomenon exists;In the third part, we analyzed the advantages and disadvantages, then pointed outits defects such as threatening judicial independence, leading to litigation take placeeasily, and the hidden danger to disrupt the normal social order;At the end, against its risks, we put forward our suggestions: first, puts forwardthe related laws and regulations; then, strengthen the supervision of the governmentand pay attention to the work which guiding the network public opinion; next,exploring the balance between the supervise rights of the public and jurisdiction.
