Judicial Social Work Under The Local Situation

The judicial social work in the professional sense has been developed for more than 10 years in China.It has made great progress in the field of research and practice because of the joint promotion of government and academia.However,as the "foreign goods" of the western system,the judicial social work has been introduced into the institutional environment and the cultural background is completely different in China,which will inevitably face many "ineffective" problems.On the one hand,on the one hand,on the one hand,the understanding of the judicial social work is still very short.In the nature and connotation of the judicial social work,that is,the essence and connotation of the judicial social work,there has not been a clear consensus,the vague basic concept,the application of the theoretical method and the lack of practical innovation are still outstanding.On the other hand,there is a lack of systematic and definite planning for the functional orientation and future development of judicial social work.This reality not only restricts the deep development of the judicial social work itself,but also does not adapt to the objective requirements of the reform of the judicial system and the implementation of the comprehensive rule of law.This study based on the local situation,takes the basic concept of "judicial social work" as the starting point,and takes the essential question of "what is the judicial social work" as the main line,to investigate the development practice and research situation of judicial social work both at home and abroad,and to reveal the internal mechanism and concept approach of the development and development of judicial social work.On this basis,we further discuss the development orientation and future trend of China’s judicial social work.It has been found that there are still some outstanding problems in our judicial social and social work as a whole: the orientation of development is not clear and the direction is still very vague;the knowledge of all walks of life is not uniform,the basic research is lagging behind;the professional ability is not high,the service depth is limited;the local experience is unearthed,the element extraction is deficient.The research holds that,1)judicial social work is the product of the social work and judicial work in the two major systems in their development and development,and the gradual interaction and intersecting of the common objects,contents and fields.And with the continuous development of social work and the gradual advancement of the reform of the judicial system,the field of intersecting and reclosing the judicial work system and the social work system will be further expanded,and the practical content of the judicial social work will be more abundant.2)the definition of the concept of local judicial social work must be balanced between "rationality" and "reality".It involves two layers of relations,namely,the relationship between theoretical abstraction and concrete practice,as well as the relationship between the theory,values,ideas and patterns of western judicial social work and the practice and exploration of the local judicial social work in China.3)the development of the judicial social work in China should be defined as the basic orientation at the macroscopic level: the nature takes place,is located in the intersecting and intersecting of the professional social work and the judicial work;onthe system attribute,it is located in the system practice with the dual attributes of judicial justice and social welfare;the path of development is located in the local practice and the West.The integration of theory is gradual and the target paradigm is located at a higher level and more integrated governance paradigm.The research advocates that promoting the development of judicial social work should be focused on strengthening capacity building,highlighting the professionalism and irreplaceable of the judicial social work service,widening the policy absorbing channels,stimulating the activeness and enthusiasm of the judicial social work service,making deep ploughing of local innovation,and enriching the local internal work of judicial society.Culvert and characteristic mode;regulate the development of professional organizations and professional institutions,and enhance the overall cohesion and discourse ability of judicial social work..
