Research On The Standardization Of The Management Of The Auxiliary Police In The View Of The Rule Of Law

In the accelerating process of the Rule of Law,consensus-supervision is becoming more strengthened,and people’s legal awareness has being improved.In such a context,as an important part of the construction of Rule of Law and public security,the standardized construction of auxiliary police force is becoming particularly essential.In February 2015,the Central Committee considered and adopted reform proposals--the Framework Opinions on Comprehensively Deepening the Reform of Public Security.The "opinions" clearly pointed out that the regulation of the auxiliary police personnel management is one of the basic tasks of the reform.Standardized management of the auxiliary police force requires clarify the long debated issue of the auxiliary police in terms of the position of the subject,nature of their act,and scope of their responsibility.Then,it requires accelerate the legislative process of the auxiliary police force system,establish a specialized auxiliary police force,and strengthen the standardized construction of its internal organization mode,to promote the market-based operation.Therefore,it is of important practical significance to explore the theory of the standardized management of auxiliary police force,so as to the lay a legal foundation for this force based on corresponding system construction.The first part of this article first introduced the concept of auxiliary police force,the current domestic and foreign scholars on the definition and cognition of the concept of the auxiliary police force,and explored its role in the current public security work.The second part focused on the nomology and economics basis of the standardized management construction of the auxiliary police force.From the angle of law,the standardized management the auxiliary police force must define its legal position,responsibility permissions and rights protection from the nomology.Through discussing the auxiliary police force’s legal position to solve its identity problem;discussing auxiliary police force’s responsibility permissions to clear what it can do and what it can’t do;analyzing the auxiliary police force’s protection right to clear its worry.From the angle of economics,the reach analyzes the necessity and feasibility of the auxiliary police force management standardization deeply.Firstly,social security as a combination of the concept of public goods,economics theory foundation has been laid the society non-governmental public security.Secondly,the socialization of police make the superior police force of the public security organ get free from the busy police affairs and concentrate on the important police affairs.The outsourcing service of government service can reduce the government administrative costs and the financial burden on national finance.The third part discussed the problems existing in the operation mechanism of the auxiliary police and the difficulties faced by the public security organs in the management.The fourth part of the paper provided some suggestion on standardized management of the auxiliary police based on the latest findings in terms of construction of the local management system.
