Research On China’s Police Security Under Rule Of Law Construction In New Period

Against the historical background of the rule of law,accelerating the construction of " Public Security under Rule of Law " has been proposed and becomes a fundamental objective of public security work and an important task with the advancement of the process of rule of law in China.Decided by the particularity and special function of the public security organs and public security work,the rule by law in public security is not only an important part of the rule by law in China,but also a necessary condition and the guarantee to achieve the managing state affairs according to law.The rule of law,in essence,is a practical reason.Given that it is a relatively new concept,we must go through a constantly expanding,deepening and gradually clear process to understand it.The purpose of researching on China’s public security under the rule of law in current is to analyze the definition of this concept accurately,to explore the related theory systematically,and to summarize the practical experience scientifically,so as to further improve and develop the theoretical system of the public security under the rule of law and provide a theoretical basis and practical guidance.This paper is divided into four parts.The first part is introduction,which describes the background and significance of the research and introduces the domestic and foreign research status,research route and methods,and puts forward the research emphases and possible innovation and shortage.The second part summarizes the law-ruled public security.In this part,the concept is reviewed and the basic connotation and the significance of public security under the rule of law are analyzed.Public security under rule of law is a new concept accompanied by the continuous promotion of the rule of law,aimed at the new situation and new problems faced in the process of China’s economic and social development,and based on the original theory and practice.As a category of “Law-based China” and“Law-based Government”,“Public Security under Rule of Law”refers to public security organs which has consistently carried out the principle of the rule of law to guide the work of all public security.It is the implementation of the managing state affairs according to law and an important way to Chinese construction of the rule by law.It is an important part of the rule by law for integration of country,government and society,which goal is to achieve the law police,law enforcement people,justice,serving the overall situation,the party’s leadership.The construction of public security under the rule of law is a great significance to promote Chinese construction of rule by law,effectively maintain social stability,safeguard social fairness and justice,force police team self-construction and deepening the comprehensive reform of public security.The third part summarizes the status of the construction of the public security under the rule of law.First review of the main progress and achievements since the reform and opening up policy of China public security law enforcement building in ideology,the legal system,law enforcement way,law enforcement supervision,law enforcement capacity achieved.Then we analyze and summarize the main problems existing in the current construction of rule by law in public security: first,the congenital absence of the heritage of the rule of law,culture foundation still needs to cultivate.The second is that the legal system is still tight and the urgent need to fill the legal blind spots.The third is to be standardized organizational management and standardization of the construction to be strengthened yet.Fourth,a clear division of responsibilities owed,division of powers is not clear enough.The fifth is the uneven quality of public security team and management needs to be strengthened.Sixth,police protection mechanism is not perfect,protection efforts remained inadequate.The seventh is the deterioration of police enforcement environment,decreased significantly enforcement authority.The fourth part which is problem-oriented discusses the basic principles of the rule of law and what a specific path the rule of law police construction should follow.The rule by law in public security construction in the present stage of our country should adhere to the unity of political construction and the construction of rule by law,adhere to the unity of administrative and judicial justice in accordance with the law,adhere to the law authorized the unified and effective control,adhere to the unity based on their own and serving the overall situation.The construction of rule by law in public security is a systematic project,involving culture,philosophy,management,laws and regulations,main quality,social cognition,legal environment and other aspects.According to the CPC Central Committee and comprehensively promote the new deployment of the managing state affairs according to law,on the basis of the public security organs to maintain social stability,promote social fairness and justice,safeguard the new demands of the people live and work in peace,on the basis of the people’s expectation for a new law enforcement strict,standardized,fair and civilized.To seize the weak links and the problems which people reflect strongly in the public security work,to reach a more comprehensive,more systematic and more high level to implement the managing state affairs according to law,and constantly improve the level of the rule by law in public security work.Finally,combined with the construction of our country’s rule by law in public security deployment and local public security work practice,the author suggests that we should focus on following seven aspects: scientifically defining the statutory authority,perfecting the legal system of law enforcement,seizing the key link,promoting the construction of law enforcement to standardization continually,promoting the team management to normalization,enhancing the efficiency of police work and police resources,strengthening public security protection,strengthening infrastructure of the rule by law in public security,establishing and fostering legal thinking,improving the legal literacy and ability;increasing legal supervision,giving better play to the functions of the legal system in public security,innovating the construction of police public relations,and optimizing the environment of law enforcement in public security organs.
