Prevention And Control Of Information-based Cyberterrorism From The Perspective Of Data Governance

Information-based cyberterrorism refers to the crime of using information as a medium or tool to carry out terrorism.It usually represents the preparation and assisting behavior of traditional terrorist crimes.Because of its serious social harm,the prevention and control of information-based cyberterrorism has gradually become the focus of current anti-terrorism.Therefore,this paper analyzes the characteristics and current governance status of information-based cyberterrorism and summarizes the governance dilemma and causes of information-based cyberterrorism in order to seek reasonable and effective prevention and control measures for this crime.Through the analysis of global terrorism data and cases,this paper finds that the information-based cyberterrorism has the characteristics of faster speed,wider range,more individual criminal and easier operation than traditional terrorist crimes.This poses huge challenge to the formulation and implementation of counter-terrorism measures.In addition,although countries have gradually attached importance to the prevention and control of information-based cyberterrorism,their strategies and studies are still at an initial stage.In order to prevent and punish information-based cyberterrorism,China’s criminal law protect the legal interests at an earlier stage by regulating the preparation of a crime as the accomplishment of a crime and treating the aiding as the principal.However,due to the extremely fast update and change of the means and methods of information-based cyberterrorism,it is impossible to achieve a comprehensive prevention and control measure through revision of criminal law.Thus,it is necessary to study the difficulties and causes of this crime in order to fundamentally solve the problem one and for all.Based on the in-depth analysis of the governance dilemma of information-based cyberterrorism,this paper believes that the root cause of the governance dilemma of information-based cyberterrorism is the lack of protection and poor supervision of Internet data.Due to this,terrorists can easily collect and use data and information to carry out terrorist activities.On the contrary,the anti-terrorism agencies have no suitable law and rules to collect and apply internet data to cope with terrorism.Besides,while anti-terrorism agencies control and collect internet data,they must balance the protection of human rights.And the lack of information sharing system and data governance technology has also brought difficulties to the governance of information-based cyberterrorism.Therefore,this paper believes that data governance shall be the first preference to break the current stalemate in governance of the information-based cyberterrorism and it shall be implemented from two aspects:building a data governance system and improving data governance techniques.Then,this paper gives suggestions on how to build the data anti-terrorism organization,operation and legislative system and apply big data technology and data sharing system to forecast and supervise information-based cyberterrorism.
