The Study Of Copyright Protection Of We-media Works

With the upgrading and extensive application of digital network and mobile terminal,a lot of We-media grows rapidly with this opportunity;it keeps on increasing and covers various forms.Current copyright laws and related laws and regulations have obvious delay in the protection of this emerging field and they can't deal with new situations.This copyright protection issue comes into the vision of people and arouses extensive attention of the public.In our court cases,infringement disputes related to We-media works are very common.This kind of cases attracts the attention of the public;at the same time,arouses a lot of reflections on how to solve this dilemma and protect the legitimate rights and interests of copyright owner.Therefore,the study of copyright protection of We-media works is with certain practical significance of theory and judicial practice.To better solve the situation of We-media works trapped by “national infringement”,it needs to protect the legitimate rights and interests of copyright owners,guarantee the continuous creations and construct good order of network We-media development.This paper has taken copyright infringement dispute cases as examples,deeply elaborated theories,legislation and judicial practice related to the copyright protection of We-media works.Based on this and for the specific situations,it has discussed copyright protection paths for this type of works.Researches and discussions are elaborated from four aspects.First,they take the summarization of the whole case process as the starting point,analyze related problems related to copyright protection of We-media works and build up direction for the following deepening and promotion.Second,this paper takes the case as the keynote,defines We-media works and then makes detailed copyright analysis of We-media works,which is focusing on protection content of copyright and restrictions for the rights of copyright owner,including reasonable utilization system,statutory licensing system and other systems.Third,it combines latest laws and law modification dynamics closely,discusses current protection situation and exiting problems of We-media works in China and then evaluates related foreign systems to provide certain enlightenment for the copyright protection of We-media works.Finally,this paper takes investigation on the copyright protection of foreign We-media works as theoretical basis,takes current situation of copyright protection of our We-media works as premise and proposes some targeted suggestions by combining our judicial practice,which looks forward to providing more benign thinking for the copyright protection of We-media works.
