Study On The Regulation And Protection Of Copyright On We-media Platform

When internet enters 4.0 stage--Internet Sharing Era,the number of Internet users increased dramatically.Social media platforms,various news clients and literary creation websites are emerging in endlessly.These platforms that provide readers with reading information through the Internet are We-media platforms.In such an environment,everyone may become the author of We-media works.The copyright infringement of Wemedia works caused by this has become the common concern.While how to deal with the infringement chaos of We-media platform and protect the copyright of We-media works is an important issue at present.This paper mainly includes five parts.The first part is the introduction,which mainly introduces the research background,research significance,innovation point and the related study review at home and abroad.The second part is the basic definition of the concept,which defines the basic concepts of We-media,We-media works and We-media works copyright,and elaborates the unique traits of We-media works' copyright,such as universal ownership,complex attribution,indistinct protection standards,marginalized subject rights,etc.Combined with the current development situation of this field,the author further analyzes the copyright rights of We-media works in rights ability and rights limitation.The third part is the infringement performance on We-media works.The author analyzes the infringement performance from creating to using,and also analyzes the infringement ways under the business operation mode between authors and platforms,and studies the infringement performance in different categories,so as to lay the foundation for putting forward different regulation suggestions on different infringement performances.The fourth part is the analysis of the current situation of copyright protection of Wemedia works.In the aspect of legal protection,the author analyzes the current protection situation from three dimensions: legislation,judication and law enforcement.In the aspect of platform autonomy,the author thinks that the defects of its autonomy lie in the imperfection of the existing platform technology protection measures and the lack of platform relief methods after works being infringed.In the aspect of authors' rights protection,the author thinks that the dilemma faced by most authors is caused by their weak legal knowledge,blocked channels and high cost of rights protection.The fifth part is suggestions on the regulation and protection of the copyright of Wemedia works.According to the analysis of this paper,the author puts forward governance suggestions from legal system,platform autonomy and author standard.First of all,fromthe perspective of legal system,the author thinks that it is necessary to improve the existing legislation on the infringement standards,following earnings of We-media works and the existing compensation standards,and establish a long-term mechanism of law enforcement protection,as well as keep the long-term effect of law enforcement and improve the efficiency of judicial adjudication by innovating trial mechanism and trial mode.Secondly,from the perspective of platform autonomy,the author thinks that we should strengthen the main constraints of the platform,strengthen the supervision by means of science and technology,and strengthen the industry self-discipline.Finally,from the perspective of platform authors,the author believes that to standardize the governance of We-media platform,we must mobilize the subjective initiative of authors,enhance the awareness and ability of the authors to protect their rights actively,help the authors to open channels for safeguarding their rights and reduce the cost of safeguarding their rights.
