A Study On Village Planning In Developed Areas From The Perspective Of Contract Theory

According to the innovation from controlling to governing in administration, it will be an inevitable trend to democratize and socialize of rural and urban planning. In the real world of diversified interests and normal bets, the essence of rural planning is interests'coordination and balance, and contract rearrangement of interests' coordination among different stakeholders. Based on the progress of related research and rural planning practice at home and abroad, the paper starts from basic principles and functions of contract, and build the analysis framework of contract. Based on the standard view of the contract, the main body, content and process of rural planning will be rationality constructed.Rural planning is the contract of stakeholders agreed. From the view of contract, this paper discusses the rationalization of rural planning from three aspects:"who compiles", "compile what" and "how to compile".(1)Equal participation of the main compiling body. The equality of contract and free will principles emphasize that each stakeholder should conclude contracts on the basis of equality and voluntary. A coherent contract encourages the main body to participate in order to realize their own interests and avoid the reduction of opportunistic behaviors. The main body of rural planning should be changed from "dominant" to "cooperative", the decision-making of rural planning from "imperative " to "participative", villagers participation from "symbolic" to "substantive".(2) Problem-oriented of compiling content. First of all, farmers, the main body of the rural planning have sufficient rights to offer development needs for meeting the vital interests. Therefore, content should focus on the public service and villagers'needs to solve the urgent major problems of villagers. Second, rural planning is finally to be implemented to space because the fundamental problem in rural areas is land. The foundation of resolving the different interests and a consistent contract, same as the basic of compiling and Implementation of rural planning, is to confirm land property.(3) Stages of compiling process. The procedural justice principle of the contract constrains the behavior of the parties, which avoids the possibility of power misconduct. During the process of compiling agreed contract, fair and impartial organizational procedures are necessary conditions to realize real justice. Therefore, we put forward the "Experienced Research in the Village" in the early stage of compiling, the "public participation improvement" in the middle period and the "interactive communication mode" in the later stage.At last, as an example of Nanpu Village, Panyu District, Guangzhou City, this article demonstrate the reasonableness of rural planning in the perspective of contract.
