Presently,the Pearl River Delta region has become one of the most dynamic,creative and developed economic center in our country,which has a pilot and pivotal role in the overall situation of the national economic development and reform and opening up in society.With the economic development of the Pearl River Delta,people have to face increasingly serious water environment,water pollution incidents have occurred from time to time.Water is flowing,and water pollution problems are often cross administrative region,relying on a certain administrative effort is difficult to solve the problem.Previously,Pearl River water pollution control work is mainly dominated by various administrative areas.However,because of poor laws,administrative division,local protectionism and other obstacles,the Pearl River water pollution control work is difficult to effectively promote.In the context of green development that our country emphasizes,the rule of law to promote pollution prevention and control is an effective way to achieve green development.In order to better implement the concept of green development,and to achieve good governance of water pollution in the Pearl River Delta,this paper takes the perspective of the rule of law on the Pearl River Delta water pollution control to make a research,striving to improve water pollution prevention system of the Pearl River Delta.In this paper,along the logic line of "discovery of problems-analysis of the problem-solving the problem",the author mainly uses Three demonstration methods of semantic analysis,comparative analysis and interdisciplinary analysis.By interpretation of Trans-administrative water pollution prevention theoretical argument,advanced legislation of reference and the current situation of inadequate reflection,the author proposes legal measures to solve the problem of water pollution control in our watershed.Legal system,management system and the relative law institution forms the basis for water pollution control laws and mechanisms.Therefore,Pearl River water pollution prevention law to solve the problem mainly resolve around the above three aspects.Specifically include the following:Firstly,against the problem that some legal principle is too strong,conflicts between local legislation exists,soft law binding is not strong,the author puts forward to improve the legal system(including improving hard law system and enhanced effectiveness of soft law).In terms of improving hard law system,it mainly includes to strengthen Pearl River water pollution control coordination and to accelerate the establishment of a sound legal systemrelated.Secondly,in order to solve the problem of lack of coordination and management of law enforcement for water pollution,the author suggests to gradually establish the specialized agencies for pollution management and law enforcement cooperation and coordination,strengthening law enforcement cooperation is an important part of improving the water pollution control in the Pearl River Delta region.Thirdly,foreign across administrative prevention and control of water pollution attaches great importance to public participation in governance,and achieved good treatment effect.Therefore,water pollution in the Pearl River Delta should encourage public participation in governance,mainly including ensuring public access to pollution information and participation in the decision-making process and improving the environmental awareness of the rights of the public and so on.Finally,against imperfections for public interest litigation system in China,the author recommends the establishment of a sound administrative public interest litigation system,and improving the civil public interest litigation system,etc.
