| For a long time, the multiple management and classification of registration for the real estate are existed in China, and the purposes of registration are mostly at the level of their administrative management, which ignored security function the real estate registration brings to property rights transaction and the significance of the market economy. As a result, with the real estate transaction increasing, the drawback of the scattered registration model is more and more obvious. Real estate unification regulations are the regulations that register the rights of real estate within a certain range that have been established, modified, and cancelled into one unified book, issue unified certificates clarifying the belongs of rights, and integrate and establish a unified information management station by unified units according to the unified procedures based on the corresponding laws. The core value of registration of real property is "to protect the rights, facilitate the masses and reduce costs". The establishment of a unified real estate registration system is not only the necessary requirement to promote the reform of government institutions and transformation of functions, further perfect the socialist market economic system and frame a modern market system, but also the basic work to implement the "strengthen the natural resource asset management system" proposed by The3rd Plenary Session of18th. It has a great strategic significance to protect the legitimate property rights of real property rights holders, guarantee the transaction security of real estate market, improve the efficiency and level of governance and facilitate the masses, especially to further robust a modern property rights system and market-based economy with clear attribution, definitude responsibilities and rights, strict protection and smooth circulation.To establish and implement a unified registration system of real estate is a long and arduous task. At present, China clearly proposes to integrate the registration duties from dispersion with multiple departments to centralization by a department, realized the "four unifications" containing the registration institutions, registration books, basis documents and information platform. Although this decision provides ideas and direction for the establishment of the unified real estate registration regulation, as to practice specifically, they are not clear about how to undertake the registration uniformly. Therefore, in order to put forward feasible suggestions for the system of current and future, this paper is focusing on the establishment of a unified real estate registration system in our country, carrying out analysis and research. Some key issues, such as the uniform legislation, integration of organizations, found of registration books and construction of information platform are discussed to provide a reference for the establishment and implementation of a unified registration system of China’s real estate.Considering many foreign countries and regions have established a unified registration system of real estate, whose experience is an important reference on China’s construction of the same system, this paper will spread like below. Firstly, author describes the specific implementation of the unified registration system in some typical countries, in this way to get beneficial experience and ideas for China. Secondly, analyzes the current situation and problems of real estate registration regulation and further expounds drawbacks of scattered registration about current registration system in China. Thirdly, basing on the situation of scattered registration of real estate, it shows us the necessities of implementing unified registration system of real estate in China. Forth, it presents possible obstacles on the road of establishing a unified registration system of real estate in China, which have to be pay attention and deal with properly. At the end, author puts forward a fundamental assumption for China’s unified registration system.According to previous studies,1) the basic content of real estate registration regula tions includes establishing optimized law systems for real estate registration regulations, integrating unified registration units for real estate, regularize unified procedures for re al estate registration, unifying brochures for real estate registration and certificates clarif ying the belongings of rights, and establishing unified real estate registration informatio n station; establishing management modes for property rights based on real estate units, thus forming the right systems for basic units made of real estate units;2)in view of a nature of long-term, arduous and complex in the building of real estate registration system, recommendations are given to implement land-oriented unified real estate registration plans during transitional periods, and establish connections with various real estate registrations of today. Firstly, establish Joint inter-ministerial meeting system, accelerate the integration of responsibilities with relevant departments, and gradually unite the registration agency; Secondly, based on land registration, progressively merge a same system with all kinds of real estate registrations; Thirdly, build and improve a compatible registration platform with the help of existing cadastral information system. |
