With the development of economy, the protection of intellectual property rights of enterprises is also increasing. Domestic enterprises started late in this area, while foreign companies are set up in many areas of patent barriers, which led to the domestic enterprises in the market competition is difficult to occupy a favorable position. Patent avoid design is an origin in the legitimate competition behavior, through the improvement of the technology scheme to achieve different from the existing patent protection scope of new technology, which can effectively enhance the competitiveness of enterprises. With the level of economic globalization, patent disputes between enterprises are also increasing, so patent evasion plays a more and more important role in the enterprise competition. How to effectively implement product patent evasion becomes a realistic and urgent problem. In this paper, Research on the application of TRIZ theory in product patent evasion and software development in the title, through the study of TRIZ theory tools in the product patent to avoid systematic application mode, exploration of TRIZ and patent circumvention of the effective mechanism, expect systematic application of innovation theory, improve the patent circumvention of quality and efficiency.At first, this paper describes the status and significance of the research, and the research status of TRIZ theory, CAI software and patent evasion is investigated and analyzed. Analysis and Research on existing evasion process, then according to the target patent propose avoidance process which is"Patent-Scheme-TRIZ", and according to the technical problems propose another avoidance process is’TRIZ-Scheme-Patent". The avoidance process of the target patent can use the TRIZ tool to help the enterprise engineer systematic to achieve the goal of avoid patent. In view of the enterprise technical problem to avoid the process not only can help the enterprise to solve the technical problem, but also can help the enterprise to solve the technical problem to generate the patent. In view of the blindness of the triming sequence of the components in the existing process, the triming priority ranking rules and the mapping model between different tort principles and avoidance path are introduced to avoid the blindness of triming. In order to help engineers to improve the efficiency of patent evasion, CAI aided innovation software is integrated into the patent to avoid the process, so as to improve the efficiency of the work of the enterprise engineer.In this paper in order to verify the proposed avoid process feasibility, positioning the mace system and oil tank liquid level detection device was selected as an object. In this paper, we use the method mentioned in this paper to design and draw a number of solutions to the two cases, and get some solutions. Verify the feasibility of the patent evasion process given in this paper.In order to assist the process and improve the efficiency of the engineer, this paper also uses Web Java technology combined with TRIZ solution process to develope a set of TRIZ problem definition, contradiction analysis, analysis of the material field, scientific effect and patent download module in one of the CAI computer aided innovation software.
