The Judicial Disclosure Of The People's Courts In The New Media Environment

Open justice is a basic principle of the Constitution and the law,is to realize the basic rights of citizens,an important measure to enhance the credibility of the judiciary,the emergence of new media,broaden the judicial public platform,bring the"visible" justice for the people.The rise of new media,on the one hand,provides a very broad platform for judicial work,and promotes the people's courts and people's judges in a larger scale and in a rich way.On the other hand,because of the media itself has the unprecedented timeliness,highly interactive,mass storage,network openness,freedom,unpredictable characteristics and great destruction,the deviation of the decision,once the occurrence of negative reports from public opinion crisis,the social impact will be more extensive,negative the effect is not easy to eliminate.Facing the new media era,how to grasp the dynamic of social public opinion timely,effectively and correctly guide public opinion,to eliminate the negative impact of public opinion crisis of judicial work,improving the judicial environment,enhance the image of the court,realize the benign interaction of justice and the media,it is very important.This paper makes a preliminary investigation on the four judicial open platforms and the official websites of people's courts,such as micro-blog,WeChat,and other new media platforms,and finds out many problems existing in the judicial openness of the people's courts in china.Through the analysis of the current situation of the judicial openness of the people's court under the new media environment,this paper puts forward some suggestions for the improvement of the judicial publicity system in china.Besides the preface and the conclusion is divided into five parts.The first part describes the concept of judicial openness,and combined with the 2009 release of the Supreme People's court "on the provisions of the six" open justice elaborated judicial openness system,introduces the present situation and characteristics of the development stage of new media,as well as the development situation of our country in the new media environment for judicial openness.The second part,from the three aspects of the right to know,the right of expression and the right of supervision,analyzes the theoretical basis of the system of judicial openness,and analyzes the value function of judicial openness.The third part analyzes the positive influence of the new media environment brings to the public justice and negative influence.The fourth part,combined with the current situation of judicial publicity in our country,summarizes the problems existing in the judicial disclosure system of our country,and puts forward some suggestions.
