Hesieardtes On Legal Issues Of Sino-russian Energy Gooperation

Currently, energy has become a significant factor in economic development and its security is highly concerned by almost all the countries of the world. China, overtaking the U.S, became the largest energy importer on the earth. Meanwhile, Russia, the largest energy exporter, has maintained the partnership of strategy and cooperation with China, offering huge possibilities to enhance their relationship in the field of energy. However, their lacking of laws guaranteeing the energy cooperation and considering political and economic benefits put the Sino- Russian energy collaboration at the risk. Therefore, it is of great practical significance to have researches about the legal issues of the Sino-Russian energy cooperation and to propose related countermeasures.At present, domestic legal studies mainly focused on international energy cooperation and energy security. On the other hand, the majority of scholars conduct research, relating to the bilateral energy cooperation between China and Russia, from the perspective of political science, economics and diplomacy. In this paper, the writer gives a comprehensive analysis of the current status of the legal basis of the Sino-Russian energy cooperation from a new perspective(i.e. the problem of cross-border energy pipelines case, one of the typical problems of Sino-Russian energy cooperation). And also feasible schemes are proposed to improve the legal system of Sino-Russian energy cooperation. Discussing the Sino-Russian energy cooperation from a legal point of view is also a meaningful attempt to traditional energy cooperation.This paper is divided into three parts. The first part is called “The Analysis of the Legislative Status of Energy Cooperation between China and Russia”. The analysis is concerned to three sections: multilateral treaties that China and Russia jointly participate and contract, bilateral treaties and agreements concluded by China and Russia and domestic law of China and Russia.The second part is known as “The Legal Analysis of Typical Issues Concerning Energy Cooperation between China and Russia-- The Problem of Transnational Energy Pipelines”. As the cross-border energy pipelines is a key point of energy cooperation between China and Russia and relevant legal issues yet to reach a consensus in the international community, the research on this issue is of huge practical and theoretical importance. This section first introduces the current status of legislation of multinational energy pipelines between China and Russia, and then points out the major legal issues involved in cross-border energy pipelines, and finally discusses the resolution mechanism of disputes.The third part is defined as “Improvements in Legal Systems of Chinese and Russian Energy Cooperation ”. In this section, the writer firstly point out that what are the existing legal problems of Sino – Russia energy cooperation. Afterwards, researches have been done to acquire that how to gain the further improvements in legal system of energy cooperation. In the end of this section, a suggestion to accelerate the construction of energy cooperation legal mechanism under multilateral legal framework is put forward.
