Study On The Influencing Factors Of Medical Patent Value

With the progress of science and technology, the rise of knowledge economy and the acceleration of the process of economic globalization patent evaluation has been gaining more and more awareness. As a kind of special intangible asset, patent may be used in multiple financial activities, such as mortgage, transfer, credit and etc. In such transactions, we first need to assess the value of the patent, which presents complexity due to the particularity of patent itself. It’s difficult to assess the value of patent, thus it has become an important task in pharmaceutical area to find the solution to scientifically and reasonably assess the value of pharmaceutical patent. In this paper, we have used empirical analysis and scientific evaluation methods(Structural Equation Modeling) to analysis the influencing factors and evaluation index system of the value of pharmaceutical patents, to explore a new path for pharmaceutical patent valuation, which provides suggestion on feasibility of how to improve the assessment system of pharmaceutical value.First of all, the progress of innovation and development of China pharmaceutical industry is analyzed. The assessment of patent value is essential to the transformation, upgrade, innovation and development of pharmaceutical industry. According to the results of domestic and international research on the value of pharmaceutical patents and the "operation manual of patent value analysis index system" written by the State Intellectual Property Office, the influencing factors of the patent value are found out.Secondly, based on the pharmaceutical patent information from a scientific research institute, the influencing factors of the assessment of patent value were analyzed using structural equation modeling(SEM). Pharmaceutical patent value was analyzed from 3 dimensions including technology value, economic value and legal value, the results of empirical analysis results showed that patent classification, main inventor, industry development trends, technology substitutability, market prospects, number of companies that market the same drug, the application statue of patented technology, R&D and registration progress, application in multiple countries, the number of times that a patent being challenged, dependency, the characteristics level of the patented technology all have substantial influence on the value of pharmaceutical patents.Finally, according to the results of the assessment of patent value, it is proposed that, to promote the development of the pharmaceutical industry, we should establish an innovative R&D model integrating industry, academic and research while the company be the main body. Meanwhile, we should focus on constructing the information platform of technological innovation, establishing the system of patent value evaluation, and forming the mode of project management operation of patent value assessment.
