Objectives: This study mainly analyzes the medical institutions administrativepenalty cases of a certain city during2010~2012, learn the city violations of law inmedical institutions and health supervision. Analyze the characteristics of illegalmedical institution, changes in trends and the problem of law enforcement andpunishment in health supervision, improve key aspects of health administrativepenalties and specific measures and provide the scientific basis for improving thesupervision level of medical institutions.Meaning: The medical industry is a special industry, it is important to the vitalinterests of people. It relies on medical institutions and their medical personnel tocomplete the works from disease prevention to treatment, from medical examination todrug use. Through the study of the medical institutions administrative penalty cases, ithelps to find the root of illegal medical behaviors and the problems of healthsupervision, find the medical institutions problems of health administrative punishment,and provide an improved method and recommendations for improving healthsupervision.Methods: The methods adopted for this research were literature collection,interview, case analysis, access to relevant data and information, a general descriptionof the use of statistical methods for data processing.Results:1. There were742health administrative penalty cases, in which medicalinstitutions of health administrative penalty cases were302during2010~2012. Each of the proportion was44.05%、29.57%、43.04%., and it was the first in the annual ranking.2. The distribution of cases: in medical institutions of health administrative penaltycases, the first was hospital, with the proportion of39.61%%, the second was outpatientdepartment with27.60%, the third was clinic, and the proportion was22.40%.3. Thedistribution of the briefs of cases: the briefs of cases were mainly in illegal medicaladvertisements, over-rang clinical performance, clinical behaviors without the right ofprescription. The number of over-rang clinical performance grew faster, which growthrate were all positive, respectively,133.33%,100.00%.4. Punishments: according to thechoice of punishment procedures, the proportion of simple procedures increased from39.00%to50.77%, the proportion of general procedures decreased from61.00%to49.23%; according to the choice of the type of punishment, warnings and fines were themost in the administrative penalty, in which warnings were accounting for49.70%,fines were accounting for38.69%; from the legal point of view which was based onpunishment,"medical advertising management approach" had the largest proportion,accounted for57.14%,"medical institution regulations" was the second which was221.75%,"Prescription Management" ranked the third, accounted for14.29%.5.Execution: the execution rate of punishment was100%in the past three years, and itwas completely independent execution.Conclusion:1. Illegal medical advertisements and over-rang clinical performancewere the main causes, health supervision departments should strengthen the supervisionand coordination of relevant departments with the medical advertising, and strictlycontrol the approval of medical institutions.2. Economic interests were the root causeof illegal behaviors in medical institutions. In order to standardize the market order ofmedical services, medical institutions must work harder with the internal management,increase health administrative penalties and the cost of illegal performence.3.Inadequate laws and regulations were the important reason for not effectivelycombating the illegal practice of medicine. Therefore, our country should improvehealth care laws and regulations, and play a deterrent law.4. The status of healthsupervision was not clearly, which leaded to the lack of authority of the supervision. Health supervision should be clear in the status, in order to ensure the smooth progressof law enforcement supervision.5. Supervisors are lack of professional knowledge andability, which led to the punishment of breaking the law far from strong, differentpunishments standards and insufficient evidence. They are affected the authority and theequity of health supervision. We should strengthen health administrative penalty, getmore training of supervisors, and improve the supervision of law enforcement.6. Ethicsis an important aspect to improve doctor-patient relationship,should enhance theprofessional ethics of medical personnel, guarantee harmony and rapport betweendoctors and patients in the medical process.
