On Legal Issues Of Environmental Contractual Governance In Chinese Rural Areas

In recent years, environmental pollution in rural areas, though improved, but compared to the city,is still not optimistic, coincided with the deepening of national reform, fully completed a well-off society in an all-round way, the key period of two hundred years, only solve the problem of environmental pollution in rural areas to rural create a good foundation for the environment, so as to better the construction of new socialist countryside, accomplish the goal of national rural reform. In view of the current situation of Chinese rural environmental governance, although there are some achievements, but there are many defects, so that the government can not better complete the task of rural environmental governance. Through the analysis, it is found that the contractual governance is the best choice for the rural environmental governance in China. Firstly, from the perspective of the contract, self governance, environmental contract theory, the theoretical basis of the comprehensive analysis of environmental governance, then sums up and summarizes advantages and disadvantages of several of our country at this stage, the common rural environmental governance model, combined with the representative countries of the United States, Japan and other environmental contract governance experience, condition analysis of the implementation of the governance of Chinese rural environmental contract should have, and how to meet the these conditions, put forward corresponding countermeasures and suggestions. This paper is divided into the following five parts:The first part is the introduction, which introduces the background, significance, research status, research content, research methods, basic ideas, innovations and difficulties of this paper.The second part is the theoretical analysis of the governance of environmental contract. First to the rural, environment and rural environmental governance is expounded, defines the core concepts of this article; and then introduce the basic content of environmental governance, are presented and analysis environment contract governance is related to the contract theory, self governance theory, contract theory origin, School of basic ideas and perspectives, guiding significance. This part is the cornerstone of the paper is to provide theoretical support for the paper’s content.The third part is the current situation and reason analysis of the environmental governance in Chinese rural areas. This part of the focus the in-depth and detailed investigation, analysis and Research on the present situation of the environment in the rural areas in China, summarizes faced by Chinese rural environmental governance problems and causes. Based on the Chinese rural environmental governance common three modes of, the analysis of the advantages and disadvantages of the three modes, so as to further demonstrate the possibility of environmental governance to provide a realistic basis.The fourth part is the research and experience of the representative national environmental contract governance. In this part, the representatives of some foreign countries use contract governance idea of environmental governance in rural areas experience of mining, the summary and the refinement, and environmental governance in rural China to provide realistic models.The fifth part is the countermeasures and suggestions for the implementation of environmental contract governance in our country. This part will be in the full summary of existing basic theory, Chinese and foreign representative areas of existing successful experience and known legal issues, the contract of Chinese rural environmental governance should have the basic conditions for analysis. Then around the basic conditions of the core of this paper, summarizes the research results, put forward the construction of Chinese environmental contract governance mechanism of specific measures and suggestions.
