Study On The Main Legal System Of Soil Pollution Prevention And Control

In recent years, with the rapid development of our national economy and the abused utilization of the land, the soil ecological system is faced with serious threat. To protect the soil environment quality, prevent and control the soil pollution and to ensure security of the land resource is a pressing matter of the moment. Although there are some scattered provisions which is not systematic,there is almost no law to prevent and control the soil pollution.At present, the formulation of the soil pollution prevention law has already been put on the agenda in China.The author thinks that the although the legislation is important, we also need to establish the relevant system according to the characteristics of soil pollution.Since soil pollution has its particularity, it requires certain principles and system to control and prevent. The main principles of China soil pollution prevention law are public participation, risk management principle and the principle of pure land circulation. The main legal system should include the soil information disclosure, information sharing system, the inspection of the soil system,the risk evaluation system,the soil functional zonation system, the soil pollution prevention funds and liability insurance system. Only by establishing and improving the prevention and control of soil pollution and soil environment protection system, can China’s economic and social sustainable development be realized.Soil pollution prevention has attracted more and more attention of the world. Based on years of managing environmental pollution,many countries has accumulated rich experience. Most countries in the world have established the legal and related systems of soil environmental protection, set up a lot of soil pollution prevention paradigm, which is worthy of learning. Based on the experience of other countries, we should construct the legal system of soil pollution system which is suitable for China.This paper introduces the characteristics and the present situation of soil pollution in China, analyses the the deficiency of legal control of soil pollution in China. Based on the experience of other countries, this paper also puts forward specific measures on how to build our country’s legal system of prevention and control of soil pollution.
