Study On The Legal System Of Wetland Ecological Protection Red Line

Wetlands, oceans and forests are the three ecosystems, which are know as “the Kidney of the Earth”, have important ecological benefits in regulating climate, storing floodwater and preventing drought, degrading pollution, protect the biodiversity. Besides these, wetlands offer many kinds of natural resources and have significant economic benefits, so wetlands are the important foundation for the improvement of our environment, economy and society. However, in the development of economy people focused on the economic benefits that wetlands give but ignored its ecological benefits. The overused of the wetlands leaded their decrease both in areas and ecological function, and also lead a decrease of biodiversity, so protect wetlands are emergency. The Red Line plays an important role in protecting wetlands and promoting their ecological function. So we should use laws to supervise the Red Line and related laws to make sure it working well.They are three parts in this paper except for the introduction and epilogue. The first part is about the summarizing of the Red Line system; the second part is how it works in China; the last part is the operations support of the Red Line in China.The first part is the basis of this paper which talks about the origin of the Red Line, the definition of wetlands, and also gives definition about the Red Line and its systems. Then, analyzes the difference between Red Line of the wetlands protection and others; distinguish the Red Line between the wetland protection in reserves and parks; discuss the difference about the Red Line of the environment quality; the rollout of resources; the permission system of sewage. Finally, analyze the value of the Red Line in protecting ecological security.The second part talks about the problems and clauses of the wetlands in China and the importance of the Red Line. Then, sum up the implement situation of the Red line in China, and especially the problems, include the benefits conflict, the unclear delineation of the procedure and responsibility, the lack of public participation and so on.The third part is the core of this paper which studies the operations support of the Red Line. First talks about the government should establish the awareness and baseline of Red Line, and change the value system of the economy development in order to make “Green GDP” come true. Next, point out we should make laws to let the delineation of the Red Line clear, include the evaluation, draft scheme, adverting, consulting, decision and publicity. Thirdly, talks about the Red Line should under the Forestry sector’s charge; the other department can take part in some related problems to make sure the Red Line works well. Besides, we should also set up monitoring institutions to supervise the wetland. Then, we should set up a responsibility systems which given priority to administrative responsibility and assisted with civil liability and criminal responsibility. Last, discusses by using different standard ecological compensation and all public participation we can ensure the smooth working of the Red Line.
