In recent years, the "three rural" issue has been the focus of the party and government work. The key to resolve the "three rural" is to solve the problefn of rural land. The reform of China’s rural land property rights system happened in the late seventies and early eighties greatly promoted the development of agriculture and increased farmer’s income. However, as the economic development, increasing of land value and changing in relative prices of production, the existing system of land property rights is no longer adapt to the economic development and need for further reform. Rural land property rights reform is related to the development of agriculture and increasing of farmer’s incomes. It also concerns rural economic development and China’s economic coordination and long-term stability development. Therefore, researching china’s rural land property rights, analyzing china’s current rural land property rights problems, and on this basis, giving China’s rural land property rights system further reform proposals and measures has important theoretical and practical significance.To analysis the current status and problems of rural land property rights system, this paper uses new institutional economic theory of institutional change and property rights theory. The methods of empirical analysis and normative analysis and a combination of qualitative and quantitative approach are also been used. Next, this paper elaborates the necessity and possibility of reform of China’s rural property rights system. Finally, the suggestions of further reform of China’s rural land property rights system are given. This paper argues that China’s current rural land property rights system has the following problems: first, the ownership of rural land property is blurring; second, the rural land contract is unstable; third, rural land is not free to transfer; the last is the current land expropriation system is unreasonable. As economic developing, for getting large-scale return of land and improving agriculture productivity requires reform of the current rural land property rights system. Increasing farmer’s incomes, reducing rural-urban disparity and promoting rural economic development also require reform of the current rural land property rights system. Meanwhile, farmer’s income diversification eases the pressures on the reform of the current rural land property rights system and the transfer of rural labor force creates favorable conditions for rural land property rights reform. This paper uses the theory of new institutional economics and property theory. According to the problems that China’s rural land property rights system has, this paper propose the following,suggestion about China’s rural land property rights reform:first, the ownership of rural land property rights should be clear and the collective system should be improved. Second, to increase farmer’s enthusiasm for land investment, long-term stability rural land contract should be given to farmers. Third, it should be allowed a free flow of rural land and rural land transfer mechanism should be improved. Finally, to protect farmer’s land rights, the current land acquisition system should be reformed too.
