Shanxi Province,as an important coal energy base in China,has made outstanding contributions to the sustainable development of the country’s economy and society.However,long-term coal export,but in Shanxi Province has not established a strong industrial base,the industrial system basically around the coal energy industry,into a "resource trap",low efficiency.Shanxi as a whole more mountains and mountains less flat land,poor land quality,on the contrary,the population is relatively dense,therefore,Shanxi farmers per capita arable land is less,contracted land is more fragmented,the overall agricultural development is relatively backward,and poor integration,small scale.The purpose of this paper is to study the current situation of agriculture in Shanxi,starting with the study of the evolution history of collective land property rights in Shanxi rural areas,to explain the context and institutional background of the evolution of collective land property rights in Shanxi,and on this basis to analyze the current situation in the change of collective land property rights in Shanxi,so as to put forward countermeasures and suggestions for the future innovation and development of shanxi rural collective property rights system,to go out of Shanxi characteristic road,to promote the modernization of Shanxi agriculture,and to provide institutional guarantee for the revitalization of rural areas.In the study of the change and development of rural collective land property rights,this paper first focuses on the historical perspective,examines the regularity of the evolution of collective land property rights,and analyzes the demand dynamics and supply possibilities of the change of collective land property rights system on the basis of the theory of institutional change.Secondly,combined with the development of rural reform policy in recent years,the land property right system and land use right transfer and other policy directions and regional practices are combined to analyze and provide the new requirements for the reform of Shanxi land system.Based on the theoretical analysis of institutional change,this paper tries to put forward the direction and possible choice mode of the change of collective land property right system,which is used to guide the reform practice of Shanxi collective land property right system.And from the micro level to clarify the inevitability of land transfer,help to clear the ideological barriers,promote the construction of land use rights transfer market practice development.The main research content of this paper is divided into three parts,on the basis of combing the relevant concepts and theories of rural collective land property rights in China,analyzes the evolution process of rural collective land property rights in Shanxi Province,divides them into four major historical stages,and begins to analyze the evolution background,evolution course,profound changes of property rights system before and after evolution,farmers’ reaction,historical effects of property rights system changes,and the impact on agricultural development.This paper reveals the current situation in the change of rural collective land property rights in Shanxi,starting from the overall state of collective property rights,focusing on the analysis of the current situation of rural family contracting economic rights,as well as the current situation and management of Shanxi to promote land transfer and production trusteeship in recent years,to clarify the problems in the change of collective property rights in Shanxi rural areas and improve the countermeasures.Finally,the feasible development path of Shanxi’s future reform of rural collective land property rights system is given,and it tries to refine the policy combination suitable for Shanxi Province’s situation,feasibility and forward-looking based on Shanxi’s current situation and lessons learned at home and abroad.Based on the theory of modern property right system and the theory of institutional change,combined with the use of normative analysis,empirical analysis,comparative analysis,digital analysis,game analysis and in-depth interview and other research methods,from the demand-caused and supply may be two aspects of analysis,it is concluded that Shanxi rural collective land property right system change is in the transition stage of system supply program design and screening,especially after the 18 th National Congress,how to develop the collective land property right system adapted to Shanxi Province’s "special" and "excellent" strategy has become a major problem.Starting from the possibility of system supply,it is suggested that the system supply scheme should clearly define the land boundary of the three main bodies on the basis of adhering to land collective ownership,construct modern rural collective economic organization through the land shareholding system,and exercise land ownership on behalf of farmers collectively.At the same time,it points out the direction of recent institutional changes: clearly defining the boundary of land property rights,that is,land rights,strengthening the protection of collective land rights,giving land users complete and stable land use rights: refining the structure of land property rights,perfecting the right of land property rights.Theoretically,research is somewhat innovative.The current focus of the rural collective land property right system is the evolution of the family land contract management right.Farmers are the suppliers of the transfer of agricultural land,and also the demanders of the transfer of agricultural land.In terms of property rights of rural collective construction land,this paper starts with the analysis of the interest game process of the participating subjects,constructs the interest game model of the transfer of the right to use the collective construction land,and provides some theoretical support for opening up the market of the right to use the collective construction land in practice.
