Relief Of The Social Security Rights Of Farmers

With the promotion of democracy and the deepening of industrialization, social security has been widely recognized as a right of citizenship while on its process of being institutionalized. Chinese citizens are entitled by the Constitution to enjoy the rights of social security, while a peasant, as citizen, is also eligible to the equal enjoyment of this right. But due to the dual system of the long-term structural development, social protection policies tilted to the cities, the rights of the peasants and its declaration to achievement have always been problematic. Right relief, being a very important part of the realization of rights, endows peasants with the right of social security relief, helps to develop awareness of the rights of peasants, and prompts the Chinese society legalization process.Based on the basic theories of civil rights remedy and the right to social security for peasants and the study of Social Security debate procedural in Germany and France, this paper analyzes the problems and reasons of the social security relief system for peasants in China’s social security system.The paper consists of5chapters.Chapter1is introduction; it mainly brings up the topic according to China’s present situation and points out the significance of social security rights for the peasants. It also generalizes the theoretical study from home and abroad, and then explains the research idea and method of this paper.Chapter2defines the concepts of social security relief system for peasants; mainly explains the relevant theoretical study and concepts of security relief system for peasants.Chapter3is the theoretical analysis of social security relief system for peasants, including Rawls’s A Theory of Justice and theory of human rights, social solidarity and no relief no right ideological theory.Chapter4discussed the present problems of China’s social security relief system for peasants from the perspective of public remedy. At the same time, it also gives reason for the lack of such remedy.Chapter5draws on experience of settling disputes of social security from Germany and France and combines the experience with our own particular case to come up with principles and strategies on how to improve China’s social security relief system for peasants.Scholars who studied the social security relief system for peasants from before haven’t systematically categorized the remedy; they prone to bring up new thinking on the basis of subsistent problems. Based on their studies, this paper innovatively categorizes the remedy and studies specifically each of the kind, making it easy and convenient for the reader to find out the present problems of the security relief system for peasants and each of them.
