Research On Marketization Of Usufruct Of Shoreline Resource

Port has important economic, military and strategic significance for a city andeven for a country, and its development and construction depends on good shorelineresource. Our country follows the long-term shoreline policy of administrative licenseand free use under the planned economic system. With the deepening of reform andopening up, the socialist market economy has been gradually established. Shorelineresource becomes scarce, and its intrinsic value is appeared. Although as arepresentative of some ports Shanghai Port has levied shoreline utilization fee,because of the low cost and unlimited duration of shoreline use, it is difficult toconfigure shoreline resource efficiently. Therefore, this article studies marketizationof usufruct of shoreline resource taking outport shoreline of Shanghai Port as anexample.This article starts from the problems of use of Shanghai Port shoreline resource,which is revealed as a natural resource scarcity, dual nature of the property for publicgoods and private goods, and complexity of legal issues. It is proposed thatmarketization of usufruct of shoreline resource can reflect the intrinsic value of theshoreline resource, can improve the government failure，can point out the direction ofthe transformation of government functions and can meet the requirements of port construction and sustainable development, so it has a certain degree of necessity toimplement. By introducing and analyzing different ways of marketization ofshoreline resource used by domestic and foreign ports, and marketization of landresource on behalf of natural resource, the feasibility of shoreline resources usingmarket-oriented is explored from the level of the existing laws, regulations and theparties support.On this basis, the market-oriented way of Shanghai Port shoreline resource use isdiscussed, which is to build primary and secondary shoreline resource using market.The country or its authorized "Shoreline Reserve Center", in the primary shorelineresource using market, through the administrative examination and approval,purchasing and storage of shoreline, shoreline use rights leasing, shoreline use rightstransfer and BOT ways, conducts the initial allocation of shoreline use rights. In thesecondary shoreline resource using market, through shoreline use rights leasing,shoreline use rights transfer and some other ways, the transfer of shoreline use rightsis made between different users. And shoreline resource performance evaluationformula is introduced. According to its results the rate for purchasing and storage ofshoreline, shoreline use rights transfer, shoreline utilization fee and shoreline userights leasing can be made.This paper argues that by perfecting legal safeguard, adjusting the functions ofthe government and taking into account the interests of all parties, marketization ofusufruct of shoreline resource for Shanghai Port will be helpful to improve themanagement of the shoreline resource for government, to configure shoreline resource,to enhance the performance of shoreline use, and also be contribute to the sustainabledevelopment of Shanghai Port.
