Legal Problems In The Import Food Safety Supervision And Its Countermeasures

Food is the basis of human survival and development and a necessary material condition, and it’s also the fundamental elements of national security. Compared with the western developed countries, China’s current import food safety supervision develops late, current law and system of imported food safety is not perfect. But the import food safety supervision pays little attention to its own design research, but focus on some other aspects like the technology learning. Therefore, it causes some problems such as various departments’function crossing and law and regulations contradictions.In recent years, with the gradual improvement of the national life, society and economy, the problems of import food safety has been the focus of the people’ s livelihood and national welfare. Recently, there are some serious problems in import food, such as "Germany Hairy Incident" and "New Zealand Imported Milk Powder Incident". It directly exposed some problems about import food which involves the lack of supervision and management system. Then the reform in this field has been a vital task. Many related departments are exploring the reform way of the import food safety supervision system. This paper contains4parts:The1st part is the review of the reported food supervision. By defining the food security, imported food security and imported food supervision, we will explain the basic principles of imported food safety, and analyze the necessity of imported food supervision.The2nd part is the analysis of current situations of imported food security supervision. And we will explore the problems of imported food safety, pointing out the existing problems and roots though the exploration of low-level, technology-level, supervision-level and information-level.In the3rd part, we’ll deal with the mode and supervision experience of imported food safety in European Union, America, Japan and Canada, By analyzing the features and current situation of imported food safety in European Union, America, Japan and Canada, I’ll give some other related suggestions on the imported food safety supervision of our nation.In the4th part, we will give some advice to perfect China’s imported food security supervision. It is based on the above parts through the necessity, the problems and some suggestions from abroad. And we put forward some practical advice from multi-levels.
