Central document No.1requires that “Carry out a comprehensive work of ruralland rights registration and certification work,ensure the survey work of the ruralcollective land ownership and the ownership of cadastral of the right to use theconstruction land, including countryside homestead is going on wheels; and speed upthe land rights registration and certification work.” The Rural collective landownership rights is an important Farmers’ collective property right prescribed by law.Carry on the rural collective land rights registration and certification work, under lawto ensure the long-term and stable land ownership rights of the Farmers’ collective,guarantee the legitimate rights and interests of the rural collective’ land. By the end of2012, the ownership registration certification rate was up to94.7%. While for Sichuanprovince till Sep.2012, it has been291414cases of the rural land rights registrationcertification, which is as76.7%of the numbers of the certification that should provide.In advancing on the work of rural collective land ownership rights certifications inYibin County, there are some things to hindering the certification work, including theunclearness of subject and object to the land ownership rights, the deformity of thecompetence of rural land property rights, the rural land circulation is not efficient andthe technique is difficult, etc. So, it has been the urgent affair to the registration workof Yibin county to propose an efficient solution to verify the ownership rights of therural collective land according to law.This article explains in details of the basic situation and the existing problems ofthe Yibin rural collective land ownership rights registration work. On this basic, inorder to analyze the deep-seated reasons behind the problems of this work, the authorreferred to the domestic and foreign research in recent years and the related basictheory, and consulted both the research result of the rural land by the second landsurvey of Yibin county and the work program of the rural collective land ownershiprights registration. The author also quoted charts and graphs and by interviews andsurvey to widely collected the initial values of the rural collectives and the masses inYibin county territory. From these, here comes to the summary of problems in ruralcollective land ownership rights registration of Yibin county.Aimed at the problems in rural collective land ownership rights registration, onone side we clarified the subject and object to the land ownership rights, try to achievethe registration and delivery of the certifications, on the other side we are proposingthe set up and improving the security system to the completeness of the competenceof rural land property rights, to promote the circulation of the land contractedmanagement right, the right of using collective construction land and the countrysidehomestead in perfect order. By this to give the rural collective land the equal rights tothe state-owned land in urban areas. After that, the farmers can really exercise theirrights of possession, usufruct and disposition of the land. The propose to reduce theworkloads and the technical difficulty in the rights registration work by carry out theregistration and application of the innovation management were also got considered inthis article. At the end of the article, the author suggest to promote the unifiedregistration of real estate and establish code to the parcel of land, in order toaccomplish rural land ownership rights registration certification, ultimately to lay thefoundation of the reform of rural land property institution.
