Compensation Standard Research Of Ground Attachments Requisitioned And Dismantled On Collective Land In Xinjiang

Since the reform and opening up, China’s economic develops rapidly, the industrialization and urbanization process is accelerating, more and more agricultural land is transformed into construction land. In the process of industrialization and urbanization, the problem of Land acquisition and resettlement has been more prominent, especially that in relation to housing and other ground attachments relocation compensation. Since2003,due to land acquisition and housing demolition, there have been a series of disputes, what has become one of the principal contradiction in current society. However the focus of the related conflict is the dispute of the amount of compensation between two sides of land acquisition and housing demolition. Therefore, how to formulate a fair, scientific and reasonable compensation standard has become the key to solve the land acquisition and resettlement disputes. Due to the different economic development levels of all regions, the Ministry of Land and Resources called on all localities to formulate relocation compensation standards of rural collective land based on the actual of the local.According to the notice, the house demolition on collective land reference to "the housing levy and Compensation Ordinance on State-owned land", that issued by the Central Commission for Discipline Inspection and the Ministry of Supervision,and the Ministry of Land and Resources’ instruction of the amendments to "the Land Management Law", based on the field research of33counties (cities) from Xinjiang’s15prefectures and cities, the main factors affecting the willingness of farmers demolition are empirically analyzed, and the measurement of the standard of compensation on the ground attachments is empirically studied, finally opinions and suggestions on how to perfect relocation compensation standards are put forward in this article.In this research, through the study on how to estimate relocation compensation standards of land attachments on the Xinjiang collective, theoretical basis and technical support are provided to develop a estimating system of ground attachments’ relocation compensation that more in line with the current actual situation of Xinjiang, it will further improve the existing collective land attachments relocation compensation standard system, will help to avoid or minimize disputes in the demolition process, resolve the contradictions among the land acquisition and resettlement, and to promote the healthy development of urban and rural construction.
