Study On Problems And Countermeasures Of Housing Relocation Policy In Rural Collective Land Expropriation

With the deepening of China’s urbanization process, the scope of rural collective land expropriation and housing relocation also continues to expand. The government fumble ceaselessly in practice, strive to perfect the land requisition system and improve the relocation policy,try to find the optimal balance point of public interest and farmer interest. The Communist Party of China proposed“Comprehensively promote the rule of law ” in 2014. The implementation of land expropriation and housing relocation in accordance with the law and to protect the people’s legitimate rights and interests, is an important measure of governing the country according to law. At the same time, this work known as the most difficult work by our grass-roots workers, is related to the vital interests of the majority of farmers, has a high degree of social sensitivity and related to China’s social stability.In this paper, the present situation of formulation and implementation of housing relocation policy in rural collective land expropriation was analyzed and researched,taking F District of Shanghai as an example.On this basis, suggestions to perfect housing relocation policy in rural collective land expropriation were proposed. The full text is divided into six chapters. The first chapter is the introduction.The second chapter, the the third chapter,the fourth chapter and the fifth chapter, is the main part of this paper. The last chapter is the conclusion.The main part of the paper at first analyzed the present situation of housing relocation of F District in rural collective land expropriation, and revealed that the main problem of policies implementation of collective land expropriation and housing relocation was caused by illegal compensation of abuse of discretion;unreasonable method of policy implementers, evaluation of illegal covert and other issues.Then, further analysis show that urbanization, urban expansion and the need for economic development is the cause of rural resettlement.All kinds of problems during the implementation of the policy, on the one hand is because the resettlement policy itself is not perfect, the development process is not standardized and supervision of the implementation of the policy is not in place; on the other hand is due to government role dislocation and the impact of the interests of all parties.Subsequently, the article introduces and draws on the successful experience of land acquisition in foreign, Chinese Hong Kong, Chinese Macao and Chinese Taiwan areas. The article finally unifies our country situation and put forward the reasonable countermeasuresand suggestions on the improvement of the housing relocation policy of China’s rural collective land expropriation by improving the rural collective land relocation policy,ensuring the relocation policy implementation, strengthen supervision and sound dispute resolution mechanism.
