The Research On The Contradiction And Countermeasures Of Land Acquisition And House Demolition In Rural Collective Land Exampld On Yongning Town Of Shishi City In Fujian Province

As China's urbanization construction continues to advance,a large number of rural collective land around the city has been levied according to law.The land acquisition and demolition of rural collective land has a great impact on the survival of farmers,which is related to the process of rural modernization and social harmony.In the process of land acquisition and demolition in rural areas,some unsatisfactory places have emerged,causing contradictions between the cadres and the masses,and even causing group incidents.Improving the working methods of land acquisition and demolition,resolving the contradictions in the process of land acquisition and demolition,is of great significance to promoting the rule of law and the internship in the new era of socialism with Chinese characteristics.This paper uses case analysis,questionnaire survey,descriptive statistics and other methods to take the Yongning Town of Shishi City,Fujian Province as an example to discuss the contradictions and countermeasures in the process of land acquisition and demolition of rural collective land.Firstly,on the basis of introducing the historical evolution and current situation of land acquisition and demolition of rural collective land in Yongning Town,through questionnaire survey and statistical analysis,it is concluded that the contradiction of land acquisition and house demolition is mainly manifested by the unsatisfied compensation appeal of the requisitioned object.The safeguard measures are not matched with the living needs of the affected people and the conflict between the government's public power and the farmers' consciousness.Then,from three aspects:policy formulation,implementation process of land expropriation and landless farmers,this paper analyzes the contradictions of rural land acquisition and demolition in Yongning Town.In terms of the policy system,there are mainly imperfect legal systems that guarantee the legality of land acquisition,lack of participation rights and decision-making powers for land acquisition,lack of compensation policies for land acquisition and demolition,lack of employment and social security systems,and allocation of resettlement housing construction.Five reasons for science;in terms of process management and control,there are mainly four reasons for the lack of publicity of land acquisition and demolition policies,insufficient management of land acquisition and management,imperfect reward and punishment mechanisms for land acquisition and resettlement,and irregular distribution of land acquisition compensation;In respect,there are three main reasons for the difficulty in identifying part of the property rights of the relocated houses,the forced increase in the cost of living for farmers,and the desire to resolve some other claims.Finally,this paper proposes countermeasures from three aspects to reduce the possibility of conflicts and conflicts arising from land acquisition and demolition of rural collective land.First,improve the land acquisition and demolition laws and regulations,including strengthening the construction of the land expropriation rule of law system,improving the social security mechanism for land-expropriated farmers and improving the employment guidance system for land-expropriated farmers;second,strengthening the management and control of land acquisition and demolition processes,including exerting the management and control role of the demolition evaluation agency and building Reasonable compensation mechanism for land acquisition and demolition and establishment of a reasonable reward and punishment mechanism for land acquisition and demolition;Third,strengthen the guidance of the object to be recruited,including establishing a correct awareness of rights,doing a good job of ideological stability and strengthening humanistic care.
