From1990s, knowledge-based economy first appeared in the United States. Following in time, the world economy transformed from an industrial economy era into the era of knowledge economy. Since then, intellectual property rights has played an increasingly important role in the global economy and international trade. Under the framework of the WTO, intellectual property rights were included in the issues of trade negotiations during1986and1994Uruguay Round negotiations. Intellectual property trade becomes one of the three pillars of international trade with merchandise trade and commercial trade. Last decade exports of international intellectual property trade nearly tripled, and had an average annual growth rate of12%. With the rapid development of the world intellectual property trade, China’s intellectual property trade in the past10years made great progress. Average annual growth rate of intellectual property trade exports is much higher than the trade in goods and services trade. Under the background of the deepening of economic globalization and more and more attention paid to intellectual property rights, it is theoretically valuable and practically significant to study the international competitiveness of China’s intellectual property trade, Influencing factors, problems and solutions.There are lots of research on the role of intellectual property rights and intellectual property protection from the economic point of view. But there are few papers about international competitiveness of intellectual property rights of trade. And there are fewer Empirical research on the influencing factors of international competitiveness of intellectual property trade. Besides, countermeasures to improve the international competitiveness of China’s intellectual property trade are not enough systematic. This paper uses a combination of theoretical and empirical research methods. Based on the TC index, RCA index, STO index, this paper Quantitatively compared international competitiveness of intellectual property trade of China and other countries. With econometrics Eviews5.0soft regression model, it conducts an empirical analysis of influencing factors on the trade competitiveness of China’s intellectual property rights. It is concluded that trade competitiveness of China’s intellectual property is influenced by Foreign direct investment, human capital, R&D investment and the degree of protection of intellectual property rights. Then, with Michael Porter’s diamond model, it analyses the existing problems of China’s intellectual property trade from aspects of production factors, demand conditions, related and supporting industries, corporate strategy, structure and competition and government. Finally this paper proposes corresponding countermeasures and measures.The main innovation lies in the use of the latest data to analyze the international competitiveness of China’s intellectual property trade. And with econometrics Eviews5.0soft regression model, it conducts an empirical analysis of influencing factors on the trade competitiveness of China’s intellectual property rights. And it analyses the existing problems and proposes corresponding countermeasures.
