Research On Benefit Game In The Process Of China’s Land Administration

With China’s rapid economic development and rapidly increasing urbanization process, the demands for land use and land market are warming, so the land relations are very strained. The land administration departments shoulder the responsibilities of approval, land use monitoring, investigating and dealing with illegal land use cases, but illegal land use cases are still frequent now.Interest conflicts due to land-use emerge in multilevel nature of multi-faceted, because of the reality of the land administrative process can not effectively adjust the complete benefit relations among the stakeholders. Integrating interests pattern and optimizing land administration system become the inevitable mission of land administration development.As the benefit relations in the process of land administration are complete and extensive, this thesis studies the stakeholder relations in the process of land administration based on game theory and benefit analysis in order to provide decision-making references to the government to better co-ordinate the interest objects and promote the harmonious development of land administration.Firstly, this paper hackles some concepts and theories, so as land administration, land administration process, interest, interest subject and game theory. Secondly, the thesis analyzes the benefit game in the process of the decision-making, implementation and monitoring. In this thesis, it analyzes the interest relationship between central government and local governments taking the farmland protection policy decision-making as an example; analyzes the relationship among the stakeholders of the central government, local government, land use enterprises, rural collective economic organizations and farmers; in the process of land supervision, it analyzes the benefit game among various stakeholders through three aspects of land-inspecting, land supervising and civil monitoring.In the process of land administration decision-making, public interest is the basis, but the distribution of interests among different stakeholders is often conflicting, so. it should optimize the present decision-making process of land administration, that is, building a decision-making process composed by interest articulation, interest aggregation, policy formulation, policy implementation and information feedback, and it is necessary to improve the legal environment of decision-making system. In the process of implementation of land administration, the goal of central government is the overall interests, which are holistic development, efficiency and equity; the local interests are local governments’main goals; the micro-economic subjects take precedence over the pursuit of their own and organizations; it should co-ordinate the goals attaining of all subjects in the process of land administration based on what the public interests achieved. In the process of land administrative supervision, China has formed a network of monitoring pattern, but there are conflicts among the multi-unit supervisory powers and subjects as different interests exist, so, the implementation of subjects and effectiveness of supervision are prevented, it should integrate the supervision rights in the land administration system, enhance the rank of supervision, strengthen the synergic relationship among the land inspector departments, environmental protection, industrial and social security sectors, promote the local governments to change their development patterns, perfect the permanent tenure of NPC and CPPCC members and ensure the appropriate supervisory powers given to Land Ombudsman.At the end, the thesis explores a system optimistic mode of land administration through five aspects of system theory, spirit of public administration, administrative trisection system, interests’ integration and principle of entropy increase.
