Research On Protect Policy Of The Land Rights Of Farmers In The Rural-urban Fringe

The rural-urban fringe appears in the process of urbanization, develops from the rural near the urban, and have the features both of urban and rural.With the qucik urbanization, development of urban have the growing demand for land land.As the cross region between urban and rural, a large number of the land of the rural-urban fringe is expropriated for urbanization. For the unreasonable place of policy, the land expropria-tion has a lot of problems, and land rights of farmers in the rural-urban fringe is violatied. In recent years, disputes occurr frequently around China,so how to protect the land rights of farmers become a policy problem which needs to solve quickly. The land rights of farmers in the rural-urban fringe is easier to violated by unreasonable policy than the the land rights of farmers in the rural.But the problem of protect the land right of farmers in the rural-urban fringe is ignoed by academia.So the writer makes the rural-urban fringe as the research perspective, on the basis of empirical study, uses the equity theory of Marxism, the theory of welfare economics, game theory and the theory of public policy, analyzes the entry of the policy agenda, the construction of policy problem, the problems of policy formulation and policy implementation, and proposes the policy recommenda-tions. This paper is made up of 6 parts.The first part is theory and definition of concept. This part introduces the equity theory of Marxism, the theory of welfare economics, game theory and the theory of public policy, defines the concept of the rural-urban fringe, the land rights of farmers, the compensation of land expropriation, the disputes of land expropriation.The second to the fourth part is on the basis of vertical logic of policy analysis, use the methods and models of public policy as a reference, analyze the entry of the policy agenda, the construction of policy problem, the problems of policy formulation and policy implementation.The fifth part is empirical study of protect circumstances of the land rights of farmers in the rural-urban fringe. The stduy chooses Miaoshan Village, Bihu Village and Nan’an Village in the rural-urbanfringe of Wuhan as concrete objects, makes questionaire and interview.The sixth part is the policy recommendations. According to the problems of the second to the fourth part, proposes the policy recommendations of the land rights of farmers in the rural-urban fringe.According to analysis, the elements of protect problem of the land rights of farmers in the rural-urban fringe is existed basically. In the current policy formulation, policy-makers is too concerned with self-interest and lack of flexibility and focus; in the current policy implementation, the division of powers of land administration department is unclear, and the awareness of farmers in the rural-urban fringe is not high. At last, the writer proposes the policy recommendations.The division of powers of land administra-tion department should be clear, the non-governmental organizations in the rural-urban fringe should be developed, and the time of farmer enter social security should be shortened.
