A Research On Legal Regulation Of Involving Terrorism’s Network Public Opinion In China Under The Perspective Of International Law

Network public opinion regulation is playing an important position of the anti terrorism. Effective control of the network public opinion is conducive to prevent the terrorist expectations to achieve the desired effects which be unlimited spread, to prevent them as another cause of violent terrorist incidents. The network public opinion related terrorism that is the set of generated with a certain tendency of attitude,emotion and speech to the media and the public, with the help of Internet and mobile terminal expression against terrorism and violent terrorist activities occurred, is the response to terrorist, extremist ideology, anti fighting against terrorism and violent terrorist events of social public opinion in network virtual space. At present, the academic research on network of public opinion under the perspective from journalism, sociology and management has been extended to the law, but research on the network public opinion related terrorist under the perspective of international law rarely involved. Therefore, this paper chooses the terrorism related network public opinion as the research object to discuss, on the one hand based to the deficiencies about the legal regulations of network public opinion in China, on the other hand we also absorb the experience of foreign countries and regions of network public opinion of legal regulation, and put forward suggestions to perfect our country involved in terrorist network public opinion of the legal regulation, hope having contribution to our country network counterterrorism cause. Besides the preface and the conclusion,the thesis is divided into four chapters.The first chapter, the summary of network public opinion involved terrorist.This part mainly explains the concept, characteristics and related theories about the public opinion, the network public opinion and the network public opinion related terrorism.We also discusses the necessity of the legal regulation of the network public opinion related terrorism. Legal regulation on the involved in terrorist of network public opinion is respond to the needs of the domestic situation, is an inevitable requirementof constructing the rule of law in China, is adapt to the international trend of the fight against terrorism, and also the requirements to participate in the global governance of the network space.The second chapter, the international law `s mechanism and practice of the legal regulation of the network public opinion related terrorism. First of all, this paper discusses the international organizations involved in the network public opinion related terrorism. Secondly, discusses the relevant international treaties involving the network public opinion related terrorism, including multilateral treaties and bilateral treaties.Finally, this paper introduces the development and practice about the legal regulation of Internet public opinion in other countries.The third chapter, the current situation and existing problems of legal regulation of involving terrorism`s network public opinion in China. First of all, from the party and the country’s policy guidance level and legislative regulation level, introduce the regulation and policy of China’s network of public opinion and clarify the status quo.Secondly, we explain the specific problems of legal regulation of involving terrorism`s network public opinion in China.The fourth chapter, the suggestions on perfecting our country’s legal regulation of involving terrorism`s network public opinion. This chapter is based on the problem of legal regulation of the network public opinion related terrorism, absorbing foreign experience in the legal regulation of the network public opinion, then coming up with the specific improvement suggestions. First of all, to propose government as soon as possible to develop a scientific long-term national network security strategy, to provide macro guidance for the legal regulation of the network public opinion related terrorism. Secondly, the proposal to improve the legislative system of the Internet,providing legal basis for the rule of law against terrorism. Finally, to suggest to improve the supporting system of legal regulation of the network public opinion related terrorism, providing an adequate security system for the legal regulation of thenetwork public opinion related terrorism.
